Got rear-ended 2.0

As the title says, got rear-ended for the 2nd time, in less than 2months:

Just as the last accident, this one also happened when I was at a complete stop. I'm not sure at this point whether I'm or the bike is jinxed =(

I had little scratches and stuff and my knee bent the gas tank somehow, but I'm fine. Not going through the personal injury claims for sure, although I have 10years to report, just in case

Going from the scene to home, I was seriously considering giving up on riding on the street for the first time ever, but can't become a ***** all of a sudden from a fender bender, can I =)

I waited for a week for the other guy to put the money together for my estimated damages ($2000-$2500), but turns out he can't. I am going through the insurance now unfortunately, and there is a fat chance the bike will be a write-off =(

Visible damages are on:

Front fairing
Side fairing
Frame slider
Engine cover
Gas tank
Exhaust pipe tip
Rear tire hugger
Bar end

Strange enough, the rim is still not bent, which both Big John at Big John's Bike Shop and two mechanics at Z1 confirmed.

I'm hoping at this point that the bike is not a write off and the repairs don't take too long. I'm getting a rental car (econ class lol) apparently, but I'd rather get a CBR125 =(
 
Did I read that correctly? You originally weren't going to go through insurance?
 
So I guess you're not going to have the bike this weekend? Might be doing a trip somewhere.
 
The plan is that I leave it at the shop this Fri, but I can always postpone till Monday lol

Not that it matters, but what's the destination ? =)

When stopped do you shift into neutral and chill or are you covering the brake/ activating the rear brake light?

It depends...

If there is a car stopped behind me with a proper distance, then option A; else, B.

Either way, this guy hit me while travelling 20-30km/h, possibly without engaging any brakes. Surely, he was on his cell phone, and he did say he was looking to the "side" for a second and he saw me on the ground.

Are the lights after market? Not sure how bright they are but I've noticed that aftermarket lights are usually not that noticible in a bad way. Also, make it a habit to check your mirrors as you are coming to a stop and while stopped so that you have a chance to take off when cars don't look like they are going to stop.

Did you see/heard the guy in Altima actually trying to brake or did he just ram you?
 
OP glad you're alright, could've been much worse! What happened that you stopped there? Traffic? I didn't see a stop sign so I'm curious. Did the cops show up and ticket the other driver? As rafiki mentioned I've seen some bikes with aftermarket tail lights where I couldn't even see they were lit up during the day. Night time they're nice and bright, but during the day, no chance.
 
This might be a REALLY stupid question, but OP are you on at least 1 of the brakes when stopped? It's not very common, but I have seen some people who can just flat foot on both sides just put their feet down, meaning their brake light is off.
 
Glad that you are ok. A bike can be fixed or you can get a new one. Live and learn from these 2 experiences, but don't give up riding just becos of these 2 incidents. You will one day regret that you stopped riding.

I agree with the above posters - what was the reason for your first rear end collision? Where you in the ready position on that occasion? Where you in the ready position on this occasion? How often do you scan your mirrors at a stop? I believe it is our responsibility as riders to let others know what our intentions are i.e. using our signals, using our brake light at stops.

I have always added additional LED brake lights on all the bikes I've owned - the annoying kind that flash for a few seconds then go to solid when the brakes are applied. When at a stop and I see a vehicle approaching, I deliberately re-apply my brakes that flash as the car approaches me.
 
Poor little fizzer. Happy your doing well. Do you think not having the red stock taillight housing is playing a factor in drivers not seeing you from the rear? It doesn't look like a write off; the front fairing, slider, chain guard, bar end, and engine cover are not too expensive.
