Off the road

Thread giving me stuff to think about as I had two very close calls with deer this year in my car. One I dropped anchor for and one I swerved around

As soon as you talk to them the put the at fault in their system. At least that was what I was told.

This is not true of all of them. I was able to discuss a possible claim without having it locked in. Their response was so lame I didn't go through on it.

Might also depend on your broker and the relationship you may have . We have had the same Gal at three different companies ( we follow her) . I can get “off the record “ conversations with her that leaves no paper trail . Many of the new style mega brokers where your call may be recorded for training purposes could be quite different .

I can't get the vid to load, but the first car on the opposite lane was waiting to make a left across my lane, the car going around him couldn't get stopped so decided to turn right into my lane leaving me the choice to hit him or go in the ditch.

The roads conditions were crappy

Same issue happened to friends daughter , new driver forced off road , OPP consider it a new driver mistake , she clipped a tree rather than the truck , she gets charged with careless driving .

Careless is a catch all. Go to court. Easy to get reduced.

That's what happened with my wife when she crashed her scooter in a single vehicle accident (low speed, low side in a round about) this year. I met with prosecutor and got it reduced, then in court the Judge was merciful and tossed it altogether after the prosecutor recounted the fact she was currently in surgery for the second time due to said accident hence why I was representing.

So much BS, forced to buy insurance and then punished if you use it. what a scam

I asked the question to one of the Ai models, and basically it comes up as a Non Contact Accident. The insurance will see it as you being 100% at fault, most likely because they won't be interested in going after the other driver. But it seems if you speak to a lawyer an can prove the cause of the damage (cam footage) you might have enough cause to force the insurance company to go after the other driver and get you off the hook.

But of course it depends on the cost of the damage, cost of lawyer, and your time to pull this all together.
It is sick when you are in an advantaged position if you suck in your guts and hit another vehicle head on, killing or maiming a bunch of kids and their mother instead of taking the shoulder of the road and ditch at your expense. It's a knee-jerk action.

This is the kind of BS that results from insurers having full control of rules and rates. Couple that with pathetic and sometimes invalid training and we have Ontario.

The self centred logic is appalling.

If someone took my car can I just take yours?

Absolutely not!

If someone took my lane can I just take yours?

Absolutely not!

If someone took your lane can you just take mine?

Yes. You don't matter. I'm in a hurry.

Since the ditch wreck was minor it would have been decent if the oncoming diver at fault stopped and offered to pay for the damage.

Mileage be damned. Drive an old 3500 series dump truck with a snow plow blade.

Can ToSlow pursue civil action for damages and future costs (Insurance)?
