Quick story, yesterday when driving home. I was heading NB. A car setting in the SB lane ready to make a turn left at the driveway. While waiting for me to pass another car behind them was not able to stop so instead of going right the decided to turn left in to my lane causing me to drive off the road or have a head on collision.

That person also failed to stop, so i decided to go after them as i was able to drive out of the ditch

So just to sum it up the person didn’t get charged or no case number cause our cars didn’t make contact.

This was the cops telling me this.

So now I’m left with a damaged bumper and have to go through my own insurance, i do have the persons info plus footage clearly showing the car 100% in my lane as I was driving in the ditch.

What a messed up system
 
Unfortunately if there is no contact it’s a ‘single vehicle accident’.

However, if you have a witness or dashcam you may be able to prove that you were avoiding a collision and that the other driver caused you to swerve to protect yourself.

Probably cheaper just to get it fixed so you don't have a at fault claim.

As soon as you talk to them the put the at fault in their system. At least that was what I was told.

Absolutely - if you speak directly to the insurance company and they have your information, they will note in in their system which increases your risk rating (actually makes sense because you have proven to them you are a risk now).

So call anonymously and ask a "hypothetiocal" question instead.

Yup I had the same issue with TD and home insurance, I called it to inquire about some potential roof damage (from that massive ice storm years ago in TO), never filed a claim, and every time I renewed they would bring it up like it was a claim.
 
Didn't help me. They gave me an "at fault" attached to my record.
Years ago I torpedoed a huge raccoon just north of Port Perry, late night. It popped out behind the last vehicle in a string of northbound traffic. Just about ripped the front fascia off the dreaded Focus and pushed the rad back. Had a look at it and managed to limp home. I was reluctant to call the insurance and state...."I hit..." That was 1100 bucks, probably cheaper in the end.
 
I asked the question to one of the Ai models, and basically it comes up as a Non Contact Accident. The insurance will see it as you being 100% at fault, most likely because they won't be interested in going after the other driver. But it seems if you speak to a lawyer an can prove the cause of the damage (cam footage) you might have enough cause to force the insurance company to go after the other driver and get you off the hook.

But of course it depends on the cost of the damage, cost of lawyer, and your time to pull this all together.

Mine was binned. They settled the claim with a comprehensive payout, minus my deductible (not liability).
Still labeled as "at fault".
