I do not believe it's illegal.

You're right. Assuming the person passing on the right is passing "in safety".

That being said, it still isn't as dangerous as it is made out to be to use that ramp during the time it is closed in comparison to the many things that happen around the GTA.

I find more risk trying to get on the Gardiner & Spadina on ramp on a bike compared to using the closed Jameson ramp. Can't even count the amount of times traffic starts moving and suddenly stops while drivers are looking over at the dog park to the right. Tons of rear-end collision debris sitting on that ramp all the time.

What is the height of the lowered barrier? I need to go measure my bikes. LoL. I'm assuming the UNSUB was on a supersport and tucked down?

I've never seen anyone go under it, rather around it - Between the pylons and end of the bar.

I think a cruiser would have a lot of trouble doing the same.
 
He went under it by lifting the bar slightly. He was too far back to see clearly, but might have been a Speed Triple.

Shot on the ride home from a Burrito Boyz meet a few weeks ago, not terribly exciting, but still illegal, and yes I needed to set the time on my camera

You're allowed to change lanes in the middle of an intersection here as long as it's done safely. Luckily the van didn't move over and cut you off, my guess is he saw you before committing.

Crazy... I go through that area pretty often during the week (depending on which way my gps recommends before I take off).

I'd confidently say that about 50% of drivers are on their phones between Eglinton and Lawrence during rush hour because it does commonly get backed up - but not always.

This is also the reason that between Trethewey and Lawrence is one of the only areas I filter through when it's backed up (given that there is no cross traffic and pedestrians) especially when traffic slows down fast around the curve with concrete barriers blocking vision.

I tend to see the aftermath of a rear-end collision about once a week around there. Which is a lot considering I may only go that way 2-3 times a week.

This is exactly why I don't leave space to let someone cross in front of me with multi lanes that can do just that.

And I don't let said kind person wave me through when another lane of traffic can run right into me.

Now I have had folks stick their nose in front of me to turn across traffic and I try to let them know if someone is coming from behind but, I'm always concerned if they do end up in a fender bender, I'll get pulled into as a witness that said, I told them it was safe when in fact it wasn't.
