I've got all that from his drivers licence

Probably pretty grey area.

Could he take him to small claims court? Almost certainly, but I think his insurer could still opt to defend him.

Also you typically have to prove the other person was at fault. If your own insurer isn’t seeing it that way it may not end well.

I assume you politely contacted the other party again to attempt to redress the damage? You did them the favour by not opting to continue with a head on collision.
 
I'm hoping that my insurance when they see the footage will wave any sorta fault

If you're come towards me in the opposite direction and you're crowding/in my lane I have no problem "wandering" over into your's to see your reaction when you clue in. It has now become a daily occurrence, mostly on concession roads for some reason (phones/infotainment centers?), that I just don't give a **** any more.

This was the straw. Stupid cnut almost killed me (240kmh+ closing speed). From then on, you *** with me, I **** with you.


She forced a guy on a Harley to take the median as a last ditch option after passing me. He crashed - minor injuries.

I am sure that answer is no part of our insurance law is that there are no lawsuits allowed unless extreme circumstances.

It sounds sketchy to me considering anti stalking laws, privacy etc.
A relative is with Peel PD and had to be cautious snooping the records for some rather minor info.

Your license plate is public info, as is VIN # etc, etc. however this only shows registered owner not the same as the operator.
 
Just to update, I received an email today from my insurance company saying after viewing the footage they deemed me 0% at fault for the incident. plus my insurance will still no faults

Means i don't need to pay any deductible and i can have a rental during repairs.

Also they are going after the other parties insurance company, i guess my insurance sent the footage

Whoa. great to hear. Too many times you hear about the insurance going the other way. Glad they are on your side.

Actually i think it was Evoex that swayed me into buying my camera when i was asking about people who had one in their car. that's been a few yrs ago now.

Glad i made the purchase as it's paid for itself many times just this one time.

Fantastic update! Congrats!

Best outcome one could wish for in this type of scenario.
