That is a 100% false statement. There are alot more variables involved even in a parking lot accident.

Yup. For instance, if a vehicle is deemed to be moving in the main aisle and someone drives into that person from a secondary aisle, the secondary aisle person is deemed to be at-fault. The insurance rules are a bit tricky.
 
UPDATE (for those who care to know lol)

Called the police earlier today- the officer is still working the case and i was told to try back on friday..

I hit a car in a parking lot and I offered the owner $75 and he refused. He wanted $600 (there was no damage at all), I told him to go screw himself. He called the cops. They arrived and asked for my licence and insurance. I was not carrying my insurance slip. The cop told the other guy that it was private property and that he could not do anything for him, he couldn't even charge me for not having an insurance slip. The cop goes to park in a shade near the exit of the parking lot. The guy comes and tells me that he will take the $75 dollars, I told him to go screw himself. I called my family and told them to bring me the insurance slip to the parking lot, they brought it and I pulled out of the parking lot, the cop followed me and stopped me. I showed him the insurance slip and he just lets me go. There was nothing to write down because there was no damage to either vehicle and I told the officer that I never touched his vehicle.

Anyways, this guy cannot get charged and made to pay you since it was private property, I'll be surprised if the cop is really "investigating" and following through.
 
According to the experts here you can get charged on private property just as much as anywhere else. I wonder if the cop didn't give a **** about the fender bender and lied to give you a chance to get your insurance slip? Maybe you were being respectful and the other guy was a ******?

One boxing day i was backing into a parking spot with my lifted Nissan pathfinder and this guy in a tiny geo metro tried to take it as I was backing in. Well I ran over the hood and my tire was in the windshield, his car was done. We exchanged info but because it was on private property I didnt report it and nothing happened with my insurance and nothing with the police. Lesson is if was in a private lot dont count on anything, and dont leave your bike unattended where there are many Asian drivers.

When I hit that guy in the parking lot I knew they could not go after me because my uncle got hit the same way and he could not go after the other guy. They can go after you only if you go along with the deal and report it and exchange your info.
 
that sounds like some sort of criminal charge there too with attempting to run over couple people with many witnesses too. Maybe Tim Horton's got a camera footage this guy would be screwed up for life.

Ok. So you're trying to tell me that we can go around and damage other people's property with impunity just so long as its on a third parties private property.

I was hit in a private parking lot in California, a woman backed her SUV right into me as I was stopped for folks in the crosswalk. Her insurance paid 100% of the repair bill for my bike. No hassles at all. FYI the cops would not come, said that they don't respond to accidents unless someone is injured.

I was in an accident in a parking lot in which someone ran a stop sign, and the cop said he couldn't hand out a HTA ticket as it was private property but the other driver was deemed 100% at fault for the accident.

So yes, you cannot get a HTA charge in a parking lot, but you can be deemed at fault or not at fault in a parking lot.
Please get facts straight before you misinform other people.

I'm not so sure about this one...my car got hit in a lot (while I was in it!) as the guy was backing up and didn't see me and basically took out my front bumper. He ended up paying me $700 for the damage (from his original offer of $200) and when I went to find out from the cops they said that unless there was video or proof that HE hit me who would believe that he backed up. The insurance would've paid my damage, and his insurance would've paid his.

From my understanding it falls under no fault unless its glaringly obvious who hit who.

It is hard to believe that someone backed into the front of your car which makes determining fault hard in parking lot accidents.

I would also not use the term "no fault" as it is technically 50/50 in which both insurance rates may go up.
 
There is SO much bad info in this thread it makes my head hurt.
1) a deductible CAN NOT be waive based on a police report and witness statement alone. The other vehicle MUST be identified.
2) HTA and Ontario insurance act are totally different pieces of legislation and cops are not insurance experts. DO NOT take insurance advice from a cop. Always call your own broker/adjuster
3) Ontario fault determination rules do include parking lots and fault will be assessed on private property
4) 'No fault' is merely a term that indicates that no matter who is at fault YOUR OWN insurance company pays the bill
4a) In Ontario the 'other guys insurance company' will never pay to fix your car

I don't remember all of the other wrong points and I'm not going back to read them.
