what constitutes unnecessary noise or improper muffler? This seems pretty subjective? My bike makes noise to move as it has an internal combustion engine. is this unnecessary or only if I rev it unnecessarily? What's an improper muffler? I can see identifying a non functioning muffler but whats impropoer?

I think it was intentionally written to allow discretion. At the time, there wasn't a reasonable standard that could be easily tested. Also it allows the police to write tickets even if you passed any quantifiable standards (for instance bouncing off the rev limiter while riding through a subdivision at night. Even with the best muffler in the world, this is unnecessary noise).

As a start, all of the mufflers labeled, for off-road use only are easily grouped into the "improper muffler" category when on road vehicles. Also straight pipes at any point are functioning as well as they ever did as a muffler, but there is never a vehicle that is/was required to have straight pipes to operate. Although in Ontario, you are not normally restricted in the modifications you perform to your vehicle, when you start pissing off everyone around you, you should expect some blowback.

Personally I am surprised insurance companies haven't completely locked down most modifications (for instance, brush bars on the front of a CUV completely ruin all of the engineering that went into the pedestrian impact zones and serve no useful purpose. If insurance companies didn't pay the claim as the injuries were more severe because of the modification you made, these ridiculous things would quickly disappear as would ridiculous lifts on street vehicles so every other vehicle completely submarines their bumpers).

SAE J2825 provides an easy to administer method (although imo, they made the equipment unnecessarily expensive, a type 2 meter would have been fine and reduced the equipment cost to <$1000. The cheapest Type 2 meter is about $300, if they really wanted to save money, they could have one calibrator at the station for all meters [although that makes it a bit easier to beat the ticket]).
 
Look guys this is going to be an interesting season. The residents of the village of Hockley are probably next in the noise war. The last two days were non stop tractor trains, two by two, all day long, straight pipes, helping boost the horse power up to about 40, but making it so the locals can't stand outside and hold a conversation. It's only a matter of time before the OPP set up check point. Or maybe on River Road, even wealthier residents who are tired of the constant weekend long drone of unmuffled VTwins in large groups. I know the tractor crowd will say that sport bikes are quite often loud, but my unscientific observations from the weekend are that the tractors out number the sport bikes by a factor of 5 to 1 these days, might be insurance costs, so I hang most of the blame for the upcoming harassment on the tractor crowd. They dress like pirates maybe they should stick to boats.
 
If the officer does have a meter and does write you a ticket, don't forget to ask him the last time the meter was calibrated.

Perhaps Bike Cop can address this, as far as I know, unlike laser and radar devices, there is currently no standard calibration procedures outlined by a court. I would assume the manufacturer "may" in the operator's manual detail "recommended" user calibration procedures and calibration intervals, (likely by the manufacturer of an accredited facility).

Unless a court has set, (via case law), calibration requirements, then the JP would have to decide if it was a factor, and then rule if it was enough to toss the charge. Also because this is a bylaw, the device can be operated either by a Police Officer, or a MLEO, (Municipal Law Enforcement Officer, or Bylaw officer).

From a non-law enforcement perspective, sound level meters get checked before and after each measurement period (depending on the measurements being conducted, this could be anywhere between 5 minutes and 24 hours) using a portable calibrator. The calibrator is calibrated by an accredited lab every year. The sound level meters are calibrated by an accredited lab every 1 to 2 years (conflicting opinions here).

Regardless of the schedule used, it is important to note that the meters very rarely drift out of calibration (this doesn't matter for the courts, just for personal knowledge). When they go, it is normally a large change and should be easy for the operate to pick up using the portable calibrator (assuming they have had some decent training and don't just blindly push buttons according to the written procedure).

So the question is, if AC/DC is blasting with Axl Rose singing, is it loud or just sound pollution????

Only went to the Hockley store once last year. Sitting outside, had to stop talking while the straight pipe cruisers rode by. Many times. Honestly I'm surprised they haven't cracked down years ago.
 
What will the straight pipers do when EVs replace all the smog-belchers? Loud stators save lives? Cooling fans with bells, suggesting Santa's Reindeer in July? Or Doof Wagon amounts of stereo speakers perched on the pillion seats? Spluttering "YURENOTTHEBOSSOFME" only wakes the Queen of Queen's Park, who then riles up the bulldogs to remind us who the boss is. Peeling out and riding kilo-meters to be metered in Peel is a merry-go-round I don't want to buy a ticket for. A Peanuts-style "The Doctor Is In" booth featuring Inreb just outside Belfountain would be a better use of our tax dollars, methinks. Joe Bass could tow a small trailer from Markdale with fresh ice creams and make it a proper scene. Make those Brits and their Ace Cafe properly jealous. #inrebrules

Ironically, the government will likely legislate that EVs emit a minimum noise level, primarily for pedestrian safety.

Apparently, loud <pipes, speakers etc> do save lives unless you ride a motorcycle and/or find yourself surrounded by holier-than-thou riders and moneyed One Percenters living in McMansions in the boonies.
