You can accidentally speed (for instance going down a hill). There is no way to accidentally drink and then drive.That's a very bold statement. How is choosing to speed less of a choice than choosing to drink?

There can be abuse of this law. Example; I took a glass of wine and a sober guy comes and provokes an accident, then they take breathalyzer tests and I come with alcohol in my system, I can get blamed even if I'm not at fault, now I'm on the hook for life? Like speed cameras, it sounded nice when race demons were going to get caught, then they started nailing housewives, businessmen, parents with sick kids going to the hospital going 55 in a 50 zone, ect.ect. All these laws are turned against citizens after a while.Finally something from Douggie that makes sense. Permanently affecting someone else's life because you committed a crime should result in permanent consequences for your life. I'd even be happy if they went further. Make the driver pay until they die and then take a portion of their estate. A permanent and lasting reminder of their bad choices in life.

It is not based on having a drink, it requires a DUI conviction. If you are driving over 0.08, it doesn't matter if a sober guy is partially liable.
