There is SO much bad info in this thread it makes my head hurt.
1) a deductible CAN NOT be waive based on a police report and witness statement alone. The other vehicle MUST be identified.
2) HTA and Ontario insurance act are totally different pieces of legislation and cops are not insurance experts. DO NOT take insurance advice from a cop. Always call your own broker/adjuster
3) Ontario fault determination rules do include parking lots and fault will be assessed on private property
4) 'No fault' is merely a term that indicates that no matter who is at fault YOUR OWN insurance company pays the bill
4a) In Ontario the 'other guys insurance company' will never pay to fix your car
