Bike Knocked Over In Parking Lot... Driver Runs.

There is SO much bad info in this thread it makes my head hurt.
1) a deductible CAN NOT be waive based on a police report and witness statement alone. The other vehicle MUST be identified.
2) HTA and Ontario insurance act are totally different pieces of legislation and cops are not insurance experts. DO NOT take insurance advice from a cop. Always call your own broker/adjuster
3) Ontario fault determination rules do include parking lots and fault will be assessed on private property
4) 'No fault' is merely a term that indicates that no matter who is at fault YOUR OWN insurance company pays the bill
4a) In Ontario the 'other guys insurance company' will never pay to fix your car

Not for standard vehicle damage. It's designed to reduce litgation costs, so the general concept is that we pay for some we aren't responsible for and don't pay for others that we are responsible for and it all comes out in the wash.

Bottom line, you are covered in a parking lot. Fault determination rules of your insurer are applied and it's not always 50/50 contrary to popular belief. You cannot be charged with HTA offences on private property other than the criminal charge of Dangerous Driving. Your own insurance pays for your damage. If you do not know who the other party is, you are still covered provided you have Uninsured Coverage. When I said the other driver will pay, I mean if he was at-fault, he will be the one getting the insurance increase. Wasted's post is spot on.

A bit OT but last night there was an accident on the street that I back onto. This is Brampton or West Markham after all! One driver, male, rear ended a female driver whom I believe switched lanes last second without checking her blind spot. Anyway, after some yelling by the man and eye balling by the woman, the man made a phone call and a buddy of his appeared, as he disappeared. The buddy claimed he was driving the car. Fortunately, as I was watching my insurance premiums go up, a neighbour was clicking away on her cell phone and got some pics of the driver. The buddy was in the back of the cruiser the last time I checked. The best part is the woman said nothing to the police about this. And that, folks, is why we pay an arm and a leg for insurance.

Theres a reason my car insurance is $500 higher in markham. Avoid it and Brampton like the plague if you can.

Wow, atleast you had some great people around you to try and help you out eh gheez. This post kind of ticks me off. How can someone be so ignorant to get out and for one, touch your bike after hitting it JUST so they can run away and then barge through a crowd of people to get away from everyone.. People these days are brave man! Hope you get some money returned for your repairs though
 
It's getting crazier every day in the GTA. The level of ignorance is off the scale!! People go about their business without a care for their surroundings. OP, I hope they get this guy and he is fried.
 
It's 50/50 if both vehicles are moving;however when one vehicle is stationary and off then I do not see how it would 50/50. Unless the motorcycle was incorrectly parked but then again I doubt it.

Best of luck to you. Hope they get him. The guy was stupid enough to drive away, thinking that nobody got the plates.

It doesn't matter. I was hit at a gas station by an old lady who drove into my drivers door. My car was parked and off. As a result I have an at fault accident on my record.

There is a difference when you open your door into traffic without making sure it is clear, Which is why you got the at-fault (May or may not have happened that way, but 95% of open door accidents happen that way)
 
best wishes, the parking lot is not public property its private and the police will maybe follow up , or not. Your likely in a 50/50 situation. it sucks but i've been down this road twice now.

Taking off from the scene of an accident and playing chicken with pedestrians makes it a criminal act. Private or public property, they can charge you.
