Not Ontario, but relevant to this board. Don't be a dick, especially not to a senior citizen. He could have been killed. I hope that Hyabusa boy ends up with some serious repercussions. (guessing on the bike)

He "touched the cyclists shoulder to avoid a Collision". No matter what spin he tries to put on this, motorcycle rider is in trouble with hta and potentially civil consequences. Maybe even criminal if he keeps making dumb statements.

As stated, what was the motorcyclist's intent?

"Touched his shoulder to avoid a collision."

Why did he get so close that it was necessary? He could have taken the other track. Push steer is amazing in these situations.

Didn't see but what about his pals riding behind him. Any moral thoughts.

From the video, the perpetrator would have a very difficult time arguing that their actions were not purposeful. This fits the definitions for Assault Causing Bodily Harm (CC267). That's up to ten years. Given the conditions under which this occurred an argument could be made for Aggravated Assault (CC268) as there was a very real possibility that the victim could have died as a result.

CC Dangerous Operation of a Vehicle Causing Bodily Harm (CC320.13(2)) also fits, though I would go for straight Assault causing Bodily Harm.

Truth is it likely gets plead down to Operation Without Due Care and Attention (BC MVA 144).

Could get all of the above (although dangerous is very rarely laid as it's hard to get a conviction). Also a charge for not giving the cyclist 1 meter, one for improper passing or similar as bike passed bicycle in the lane the bicycle has possession of, failure to remain, etc. The list of charges that could reasonably get convictions is long.

DD in my mind is choosing to race or engage in an activity that is reasonably likely to injure someone. The assault is obvious but to what degree. Denial in the face of hard evidence should maximize the penalty.

As would his legal bill. Apologies and contrition are a lot cheaper.

Won't maximize, but he certainly wouldn't get any benefit of the doubt without contrition. Then again defendants seem to be quite good at manufacturing contrition, when they're really just sorry for getting caught.
 
18 yo scumbag crashed into douggie earlier this year and recently fled a head on crash that killed a father and injured a family. F Jaiwin Victor Kirubananthan. Get the trials done quickly and ruin his entire life. He deserves it.

Our penal system is based on rehabilitation not punishment but once in a while we should consider the latter. Really, really hard punishment.
 
This guy is off to a good start. Two high speed dangerous driving crashes within six months and bodies left in his wake. If he is ever allowed to drive in Ontario again, the system has completely failed. Time to enforce driving is a privilege and he has lost it forever.

He needs his license to work as an uber driver. JOP will give him leniency.

And a sentence to incarceration will detrimentally affect this fine upstanding young man's (his mother has been quoted as saying "He's a good boy.") refugee /landed immigrant status, possibly resulting in deportation.

Dangerous Operation Causing Death is worthy of deportation, if he's not a citizen.

Exactly. Judges/JP's need to move society way up in their logical process and potential negative impacts on the convict way down. If you did something that hurts society (especially if your actions support an unwillingness to learn and be better), here's the appropriate sentence. If that destroys your life, that's not our problem. Actions have consequences, go f yourself back where you came from.

The vast majority of immigrants work harder and are more law abiding than born Canadians, or so say the statistics. Those who aren't haven't earned the right to stay here.
