What would YOU do?

I personally would love to pick up the bike although after having a court case brought against me for trying to help previously during an accident for damage I refuse to do it anymore. Sucks cause I feel bad and some schmuck ruined my good warm heartedness.

I'm sure people want to know so here is the deal:

I came across a rolled over vehicle with two occupants in the middle of the winter. Clearly they had hit ice and traveled through a ditch and rolled over/into a fence and ended up in the farmers field. I pulled the two occupants out of the vehicle after assessing the risk of the cold vs injury and provided shelter until emergency services responded. I thought all was good and but 3 weeks later I received a registered letter requesting payment for the damaged fence even though I had nothing to do with damaging it. Ultimately I had to get a lawyer involved and lost some work time.

In a life and death situation will I help? Most definitely however any other time it's a tough call and I will treat it on a case by case basis. Here is some pics as everyone likes those. I obviously took them after while I was letting my adrenaline cool down before continuing my drive to work.

That's a pretty screwed up situation. I'm pretty sure you can thank the insurance companies involved for trying to get everyone they can to pay whatever they can so that they minimize their payout and maintain maximum profitability for their dollar-sucking, soulless company.

Even so, I can't imagine a human being that I could ever have any respect for just walking/driving by in that situation. If everyone takes the approach of "don't get invovled it may hurt you" that world would be an even more screwed up place than it already is. Good on you for helping out. Sorry you were on the receiving end of our screwed up society's desire to squeeze every penny out of people.

It was back in 08 but if I remember correctly it was actually an insurance company not sure if it was the property owners or the people who owned the vehicle.

Thats very messed up the ins company should not have done that it goes against the Good samaritan act.. Asuming you were in ONT at the time

That was the thing they claimed the damage was not directly related to the provided first aid.

Now lets say this: i go over and being the good citizen that i am... Attempt to lift the bike. As i lift, i feel a sharp pain in my back (for example). Now i am off sick from work. Will the motorcyclist be willing to call their insurance company to assist me?

You would be convered by the insurance company under the good samaritan at least in part. I take back what i said unless they are injured and you are directly tending to them No. Not sure if you can make a claim or not.

What a sleeze bag move you should have gone to the press. In the end how did it get resolved?

Courts through it out. As for the press I didn't want the attention. It really wouldn't have accomplished anything in my opinion.

See personally I feel it's not their responsibility. If you are not physically able to perform the assistance then you shouldn't do it. Unfortunately accidents happen and if you injure yourself helping someone with their material property then I think you should accept responsibilities for your actions. Now if you ijured yourself saving someone life or preventing further injury then that is a different story.

Really this goes back to the fact we now unfortunately live in a society based around a sense of entitlement. We need to get out of this mentality and hopefully become a little more accepting of our own actions and take the responsibility.

My point was simply that the risk to me hurting myself was greater than the chance of further damage to the bike while on its side.

Depends on the situation.. not a cut an clear answer. All i can say if i would want someone to Help so I help.

If this person came back, i would definitely help them pick it up. But without the owner around and the bike not being in some kind of "danger" i would leave it be.

P.s i was on the ttc yesterday and an older lady came on. There were no seats available so I gave her mine. (I'm not a terrible person... I think)

I think you start with the premise of wanting to help. IF you get injured providing help that's an accepted part of helping and you shouldn't expect to get compensation for it. IF the helped party offers then be grateful and make your choice of accepting or declining.

Of course I also recognize that all things are a two way street so one would think the helped party would also feel bad and want to help and would offer help to you in kind in whatever capacity they can.

I would gladly pay that and then shove it up their *** in the social media planet and press.

Great attitude.

I suppose you'd walk by a car with a kid in the back seat roasting in the sun as well because, you know, don't want to be blamed for anything or accused of molesting a kid. And if someone is laying on the sidewalk with a knife in them and bleeding all over, just walk on by. Don't want to try to stop the bleeding and save their life, someone might think you stabbed them, after all.

Gotta love people. Christ.

Are you seriously trying to compare people in situations where there lives are in danger to a fallen bike on the street?

Gotta love stupid people. Christ.

I would take a lot of picture to prove it wasn't me that dumped the bike, pick it up and leave a note. Well actually the pics probably would prove anything but I'd take them anyway.

For the 2nd time this summer, I've seen a parked bike on its side with the owner nowhere around. I'm guessing someone either hit it while failing to park, or some drunk idiot knocked it over. (one of them was on a side walk close to entertainment district).

What would be the right thing to do?

Pick up the bike and leave a note or something? No one wants to be in a rush home, and have to deal with a flooded bike.

Leave the bike where it is on its side?

What would YOU guys/gals do?

Would you want someone you don't know picking up your bike if it was dropped? Even with the potential if it accumulating even more damage from a second accidental drop etc..
Drop the camera, pick up the bike, i have done it a couple of times - I am sure the owner wouldnt mind

I would piss on it, then set it on fire.

Geez, you just gave fraudsters a great idea.

To everyone who's been thinking a timestamped photo will prove they didn't do it, well...
Time stamp proves nothing. You could have knocked the bike over, then take a pic of you beside it, wait a few minute and then pick it up.
A photo time stamp proves absolutely nothing, except that you were standing beside a dumped bike.

Blackie/Marta is about 5 feet tall and 100lbs and I've seen her pick up a GSXR600 race bike.

If you're a fully grown adult and can't pick up a normal sport bike or standard bike without hurting yourself you should probably just give up on life in general.
