Can you be mailed a 172 after the fact

Its scary, but it is possible. What makes this even more disturbing is that the average person is generally at estimating speed and is easily influenced by the type of vehicle driven and the sound it makes. I remember reading a test from a british magazine asking ppl to guess the speed of bikes varying from cruisers to sportbikes equiped with both stock and aftermarket exhausts. Even though each bike was travelling the same speed (i.e. exactly the spd limit), people consistently guessed, unsurprisingly, that the sportbike with the pipe was travelling well in excess of the limit.

Ive seen this happen with my own eyes before. My friend took delivery of his new car, a bright yellow C6 Z06, and took his wife out around the block. They were going at the limit, but the car is loud (factory exhaust) and as cheesy as it sounds, it "looks fast standing still" haha. 20 min later, York Region police ended up at his driveway claiming that they could charge him based on neighbor complaints that he was driving "100 kph+" on a residential street. After being questioned for half an hour, nothing happened in this case, but all it takes is a neighbor with a chip on their shoulder to ruin your day.




LOL... hold on, you're saying that I can claim my neighbour was street racing, and if the cop believes it, he will be charged?? WTF!!! So much for justice.

There's this guy I know, nicest guy I've ever met. Straight shooter, no criminal record, very mild mannered and not a bad looker to boot... he was arrested for allegedly getting frisky with a cager's side view mirror after an altercation on the road. The best part? He was arrested 6 days after the "incident" occured. The arrest was made based only on a statment provided to the police (albeit 5 days after the incident, because the "police lines were busy" the first time he called when the incident happened). The cop didn't even ask the acused where he was the day the incident happened... I **** you not. I won't even get into the fact that this yahoo who called the cops was a accident claims benefits specialist.. that's a whole other story.

If someone can be charged AND arrested (criminal charge, misheif under) based on a statment provide to the police over the phone after the fact, why not 172?

you would not be mailed but rather served for an hta 172 violation. i.e the document services people would come to your door.
the time limit is 6 months.

in regards to the citizen, they would go to a j.p and sign an information rather then go to a police officer. luckily for you many citizens do not know they can do this.

police as mentioned earlier can charge for upto 6 months based on R+PG. they just fill out an information

can they still impound the vehicle if it is parked in a private, locked garage?

Ever hear of a "warrant" ...

Also, ever hear of "the right to remain silent"... It depends in whose private garage the vehicle is stored, yours or your buddy's :) They might get a warrant and get it if it's in your garage. But if it's at your buddy's and you keep your mouth shut, how are going to impound it if they can't find it?

If they can see it without entering the garage, and if it's material to an investigation, then they don't need a warrant.
 
You should read it as, "He broke the law and is trying to hide his vehicle from police. Oh, there it is."

Does the presence of a motorcycle indicate that the suspect is guilty of anything? If a grumpy neighbour calls the police (justifiably or not) because they took exception to your riding, there's a reasonably good chance that they'll find you in posession of a motorcycle. If i call the cops on my neighbour because he's mowing his lawn at 5am on a Sunday, there's a pretty good chance that they'll find that he does in fact own a lawn mower. It's a self fulfilling prophecy.

With the frequency of petty disputes between urban neighbours, I don't think it's fair that someone can make a simple phone call that can result in someone's vehicle being towed out of their driveway and their license being suspended. Once upon a time i had the Halton Region Police show up at my door because someone didn't like how i was driving my Capri and called my plate in. I honestly don't remember doing anything questionable around that time either but when the officer showed up at my place we had a fairly friendly conversation about how big a heat score my car was and that i should really be driving on egg shells to avoid unwanted attention.... regardless of whether or not i do anything wrong. That was back in the pre-HTA172 days. Who knows what would happen now. A Foxbody Capri with Mickey Thompson ET Streets and Sportsman Frontrunners must have been street racing somwhere sometime.. impound it!

Right, let the judge in the courtroom decide that days or months later. Not some highschool drop out with a badge who shows up at the house right after the plate got called in...

And if the person is smart enough to sell the vehicle before going to 1st appearance, I'd like to see what the court would do after...

No kidding. For something with such heavy (non refundable) consequences even if found not guilty the measuring stick for evidence should be much higher than a phone call. God forbid someone gets the plate number wrong.

I've had people threaten to call in me for speeding while I was driving my bike 5 below the speed limit. Perception and fact are 2 very different things. Police should never lay a charge unless it can be successfully prosecuted and having a non expert with no real evidence as your only witness won't go far (or shouldn't).
 
Very disturbing to read what is possible .... Which other modern democratic jurisdiction has the same, how should I say it, weird laws in place which give so much powers to someone with zero evidence? Where I come from, you'd have to have pretty darn good evidence for a police to show up at someone's door step with questions and accusations.
