I received a phone call from the total loss department at State Farm, they offered me $8907 (that includes HST) as a fair market replacement value, which is $100 less than what I paid for the bike in March, 2011) so I thought it is fair and accepted their offer. They have also provided me with a 2012 Nissan Altima loaner for 2 weeks free of charge. Fair is fair.

The bike was estimated $7,500 to fix, and was written off as IRREPARABLE.

I did ask whether I have the option to "buy" it back to use on the track, the answer was negative. (Because the bike had a lien on it with State Farm, this option was not available, as they don't want to take responsibility)


The only downturn to all this was me not having a bike for 2 weeks, the hassle and time to find a replacement, and the feeling of loss due to the sentimental attachment we all have to our bikes.


All in all, very pleased that; a) nobody was hurt, b) State Farm made this a very pleasant claim.


Ride safe everyone and thank you for all your help.

Time to find a new ride :)

Incident:

I went inside to pay for gas, as I was stepping out I saw this van backing into my bike literally in front of my eyes, but it was too late to run as the bike was already on it's way down :(

Last year my 07 was stolen, and now this! Some luck! :angry4::angry4::angry4:

Irony #1 - I usually pay at the pump. (but not this time)
Irony #2 - My frame sliders are actually in the mail!!


Cracks and scratches aside, there is a dent in the frame which worries me and I suspect the bike may be written off as total loss? Anyone with similar experience please chime in.

Visual damage:
Front fender split in half
Stator cover scratched
Tail section scratched
Side fairing cracked
Mirror scratched
Fork scratched

There could be more damage that I can't see...


Moral of the story: Always pay at the pump


I DO have the driver's Insurance and Driver's license info reported to my Broker

the driver is at fault, hope you got a police report w/ his insurance information.

I'd go throught insurance, its his fault.....looking at $1000+ damages there....
 
I'd say put an insurance claim.

You shouldn't have a deductible and no fault assessed to you. I wouldn't try and get someone else to pay up could be messy.
 
Its cuz its a gixxer, its societys way of getting rid of them!

Juuust kiddin!! That is some bad luck right there, but at least you got his info and have insurance which alot of people forget to get! lol
 
They should have the cameras set up at the pumps to catch those who gas and dash... maybe it caught him backing up into the bike just in case he tries to dispute it somehow.

See if they will release it to you in the next day or so just in case they still use tapes and not a DVR.

darn that sux. hope the driver will pay up.

Nothing to worry about there. The OP's insurance will pay out the claim whether for repair or replacement. Because the OP's bike was parked, the OP will not be deemed at fault so his rates will not be affected by the claim. Because the other driver is known, the OP pays no deductible.

If you're going to have a bike wrecked, this at least is one of the best ways to have it happen to you.
 
Great you got such detailed photos. We should all be so lucky in these cases.
 
Uuuuuugh! That sucks. +1 to putting it through insurance, unless the van driver is willing to hand you a couple k$? It's not your fault at all. And I certainly hope the van driver was extremely apologetic.
 
FYI: Stunnters INC did my insurance claim last year, and I was more than pleased!

I'd go to them ....
 
Hope it works out in your favour, it sounds like you've got it handled.

I always pay at pump, hardly ever even get off my bike. The one time I went inside to get a drink on a hot day, some lady almost ran my bike over because she was speeding around the corner (and didn't see my bike behind the pump). Luckily she stopped in time. Damn moms in minivans... I swear she was drifting in that Honda Odessy.
 
btw is it a stock exhaust?

That's the stock pipe off an 06-07 GSX-R... must of modified it somehow to fit his 09.

OP- sorry that you have to deal with this kind of BS, but if it helps I don't think your frame sliders would of helped as much as you'd hope. Considering that it fell on a curb and not a flat concrete surface. Hopefully it's all cosmetic and no serious damage was done.
Post a picture of the dent in the frame if you can, interested in what might be seen as "write off".

Since this happened on private property I think the insurance company will deem both parties 50% responsible.

I'm going through this now...'cept the driver hit my bike and left...
It is 0% your fault and since you've got his info, you pay no deductible...

My bike damage is estimated at $1800, looks like yours is about the same

good luck, and i know how much this sucks...you're gonna miss like 3 weeks of the season now =(
 
Go through insurance, point out the frame dent, have it written off, get a new one, and buy back cheap this one to turn into a track bike.
 
not in this case since the rider wasn't on his vehicle and it was not started.

The OP was parked properly at the pump too. Not jutting out, or hogging the space or anything. If the van driver wanted to contest it, they wouldn't have a leg to stand on. I've had vehicles hit on private property before (school once, Best Buy another time), I was never considered 50% at fault. The driver who hit my vehicle was always deemed 100% at fault.
