Because in Ontario, your own insurance company pays for your vehicle damages (Direct Compensation Property Damage) and your personal injuries regardless of who is at fault. They don't even recover such from the other insurance company of the at-fault party as it should overall wash-out between companies and there should be savings on the legal costs to do such. Did you vote NDP?
I can imagine that the only time an at fault party would agree to pay your damages would be if they 1. didn't understand DCPD, 2. want to avoid an official accident report with a corresponding finding of fault by their insurance co. and related policy increase...
I wasn't very clear I guess; my insurance company didn't like the fact that how I tried to negotiate with the guy and waited for a week to call in, as opposed to calling in on the same day.
And I don't vote. I'm on a student visa =)
