Neigbor hit my bike

My wife called me last night while I was out getting groceries. One of my Neighbors backed up into my bike and knocked it over.

Damage didn't look too bad, mostly just the plastics and and a couple of other parts. My neighbor was very appologetic and offered to pay for everything without going through insurance.

I wasn't able to get a good look at the damage in the dark, but figured it would likely cost around a grand to replace the damaged parts. So I went to the dealer this morning and got an estimate. almost exactly $3000 (including 4 hours labor) to fix, and that doens't include the bearings which I've got to get checked to see if they're damaged.

I have a feeling my neighbor isn't going to be so keen about not going through insurance now. ;)

non motorcycle folk (and even some motorcycle folk) don't realize just how much damage can happen from a 'simple' tip over.

what can ya do...

Hopefully your neighbour doesn't try and screw you.

Ouch. that sucks. One of my neighbours knocked mine over a few months ago and denied/admitted/denied it (long story). Luckily my total damage was only around $200 in parts and a few weekends of labour.

Same thing happened to me and it was $4,200 damage.
He said call him and he will decide to either pay or go through insurance, and when he heard how much it was he thought I was trying to rip him off, but I showed him the quote and through insurance I went.

Ya I have a feeling that she's going to think that I'm trying to rip her off too. But I'll give her the parts list and let her spin her wheels calling other honda dealers if she wants. prices will the the same everywhere. only thing that might change is the cost of labor, and not much at that.

Neigbours/friends and even family quickly change their tune when money is involved.

Had a friend run into me last year and we both went down, at the time he promised to pay for all damages etc. $2,500+ to fix his bike, meanwhile he thought $900 just for a couple parts on my end was too much. I did all the labour myself, got the bike checked out for free, and even used spare parts i had laying around and he still didn't want to pay.

I was also wearing a 1000$ + arai helmet that i "tapped" in the fall, still didn't get a penny for that as well.

Good luck and let us know how it goes.

How does that work exactly? How can you get him/her to provide you their insurance info or even admit that they did it?

Wouldn't this be comprehensive? IE you pay the deductable and they fix your bike?

why didn't you go through insurance after the non-payment?

The neighbour admitted responsibility. Done deal. They gotta pay either privately or through insurance.

I sympathise that the neighbour's mistake may get costly but then they had a choice - don't hit the bike. If you screw up you should pay.

he kept putting it off. at first he was gonna pay then did a 180

Had a friend borrow my vehicle+trailer to drop off his bike he sold to a guy. He ends up jackknifing it backing it up and putting a big scuff/indent on the rear bumper and a nice dent in the metal right under the tail light. Offers to pay. Tell him estimate which was $650+ and he was mad since it was "just a dent in a grocery getter." Little pissing match ensued. I ended up swinging a cash deal with a body guy I know to save him some money. Sucks for him since he only sold the bike for like a grand plus filled my gas tank. lol

If you wanna be nice about it, you can probably fix it yourself for less than half of what the stealership is quoting you.

After receiving the qoute, neighbor decided that insurance is the way to go. Now I have to go to the collision reporting centre tonight. Hopefully this doesn't take forever. :/

Still have this guy as a friend? Or more of an acquaintance now?

Hahahah
More of an acquaintance now

This isn't the first time ive been burned, but hopefully last. I lent another friend 4,000$, got him a job through my company and trained him on my time.
When it was time to pay me back he no longer answered the phone. Gotta love "friends."

Time for you to start sending the goons to "visit" these people.

Close Friend Died last year, He Lived in North Jersey, and I knew he was "Connected" often offered to take care of "Stuff" for me. Those are the kind of friends you want to keep on the good side of! At the funeral You would think you were at an Episode of the Sopranos. about half were in leather coats, sunglasses and greased back hair.

A work friend asked to borrow my brand new truck and my brand new enclosed trailer to take her $1000 bike to the shop. I declined because the truck is twice the size of her car and the trailer is even bigger than the truck in width so taking it through the narrow downtown is even tricky for me plus it's all brand new. I dont do "business" with friends. To them it's just a truck or just a trailer.

They gotta pay? Yes and no. The neighbour admitted responsibility... insurance gets in the picture, and then it is up to them to determine who is at fault. The adjuster will use the Fault Determination Rules - Regulation 668 under the Insurance Act (R.R.O. 1990, Reg. 668 )

Let's take a look at section 17 for parked vehicles:

17. (1) If automobile “A” is parked when it is struck by automobile “B”, the driver of automobile “A” is not at fault and the driver of automobile “B” is 100 per cent at fault for the incident.

(2) If automobile “A” is illegally parked, stopped or standing when it is struck by automobile “B” and if the incident occurs outside a city, town or village, the driver of automobile “A” is 100 per cent at fault and the driver of automobile “B” is not at fault for the incident.
O. Reg. 276/90, s. 17.

I guess the question is... was the motorcycle parked "legally" or "illegally?
Worst case scenario, the motorcycle is at fault 100% ...
OR the adjuster cannot determine it, and dings both parties (50% each). Everybody loses (edit: everybody except the Insurance company)
