Damaged package from UPS, No Insurance???

So I bought a gas tank off of a guy on another forum and he shipped it UPS, Packaged arrived and was busy so I signed for it, paid the brokers fee's and when I ended up opening it there was a dent in the side of the tank. The seller showed my pics on and off the bike with no damage and the dent looked very fresh.
So I emailed UPS's claims department and they sent a guy over to what I thought was to look at it but he said he will send it back to the shipper and couldn't really answer my questions without the hmmm's and humm's.

So my question is has anyone gone through this before?
If its being sent back to the shipper, is it at his expense?
How does the money get reimbursed back to me (It was paid through paypal)?
How long does the process usually take?

I will call them when I get home and ask, but the phones are down at work today, So I thought I would see if anyone has gone through this before.

Dang that sucks all around. UPS isn't pronounced Oops for nothing.
 
Good luck. I have a smashed touch screen computer that UPS smashed. I had 5K in insurance and they still reneged. It is the heart of our very expensive timing system. The only way that they will consider payment is if I turn it over to their "experts" for two weeks to survey. It is a one of a kind proprietorial software system that is the heart of our RFID timing system, NO WAY are these idiots touching it. The software is fine its the PC thats smashed on both corners a blind man could see the damage. Lesson learned UPS will never get any future business from me.

The guy mentioned they most likely send it back to the shipper and then I get the money refunded, but he didn't know who or when refunded me?

Other than filing a claim with UPS, you can always file a claim through the resolution center in Paypal as well and see how that goes..

Anything $100+ I would pay for insurance for shipping as if you take a look at many youtube videos on FedEx and UPS delivering packages, they tend to toss it and not give a crap.
 
Unrelated, but had a bad experience with USPS insurance a few years back. Had a Corbin seat sent to me and the box arrived looking a bean bag chair. Seat was ok except for a couple small tears at the very back of the seat that were very obviously caused by shipping damage. Tried to claim it through USPS insurance, they were such a pain the *** to deal with and any correspondence took forever to get a reply that eventually I gave up. This is of course what they want. Their gameplan is to drag things out for as long, and make things as difficult as possible.

Similar experience when I tried to use the theft protection coverage through my credit card.

Thats the problem, The guy cut me a nice deal on the price and I know it wasn't his fault it was damaged so I don't want to totally screw him but I don't want to screw myself either.
 

Except this one has 2 nice creases and the paint is chiped up at both points.


its a hassle if you paid for insurance, even worse if you didnt...

So what happens?
They took the gas tank back to their damage center and said they were sending it will be most likely sent back to the shipper and left me with a damage return slip?
I jut didn't know what the next step is or how and when I would be reimbursed and by who if it happens or do I just get the tank back a couple weeks from now? I will give them a call tomorrow and see what they have to say.

I just feel like an *** doing it to a guy that was trying to help me out, But then again I don't want to be out with 2 dented tanks. when I purchased one that was supposed to be in good condition with no dents.

Its really up to you. TBH, I would make a claim on paypal to get my money back. They will ask for a picture and description of what you ordered and what you received. I understand you don't want to do it cause it may not be the seller's fault but if you don't want to take the hit, then those are really the only options you have. On top of that the seller will then know not to use UPS.
 
Just my $0.02. The shipper chose to use UPS as the carrier and also chose not to insure the parcel. Substitute John Doe private seller dude with XYZ business seller company and the question would not have been asked.

I realize that the perception changes as the seller is a private individual so you may put yourself in that persons place and see this from a different perspective but I think grey is being added to a black and white scenario.

Thats exactly my predicament, If it was a business I wouldn't have thought twice to send in a claim with paypal.
I just hate that the guy gave me a good deal to help me out as we have talked before on another forum.

In all honesty I might just shoot him an email and say take it back and split the shipping with him, If I do that though will UPS just send it back or will someone have to cover shipping costs again?

2. You should have insisted on not using UPS.

1. The whole tank was double small bubble wrapped with big bubbles on the top and bottom with "UP" and an arrow on every side. (Box must have been dropped hard on its side)
2. I have never used UPS before and assumed he would have used USPS as almost all packages I have received from the states is shipped that with no problems.
3. I paid $100+ shipping for it and didn't think to ask him to make sure he put insurance on it. (My own stupidity)
 
Why are you guys blaming UPS, to me it sounds like it was not packaged properly. Thats not UPS's fault, especially if it was not marked FRAGILE...

When you buy a tank from a dealer or a good motorcycle salvage place, ore even someone that has half a brain, they will pack the tanks good enough so they cant get damaged even if you toss the box around..Ive bought many tanks new and used, and they always come packaged properly an undamaged after shipping from the US or even Japan.

Its not your fault he didnt pack it good enough, its the sellers fault for not packing it properly so it wont get damaged during shipping....If you used Paypal file for a refund, notify the seller and give him a chance to take it back and refund you before hand, but if he refuses file a dispute

Agreed but regards to #3 I used Purolater for a while and insurance was 3% of value IIRC. (I asked them if they lost 3% of their shipments) In reality what a lot of people do is self insure, charge but don't put it on. Since the couriers don't lose many packages the money the shipper pockets creates a nest egg if the occasional box goes missing.
