Please help!!!! My deposit money and a quebec dealership

Just speculating re the Quebec purchase but the OP may have gotten a really good price and then someone else showed up willing to pay closer to list. The shop owner went for the bigger bucks.

Quebec laws can be quite different but not unfair. Helps if you are bilingual. Good advice in the above posts.
 
I think that is exactly what happened! They were profiting more from someoneelse. I've already brought this up to Kawi Canada and sent the supporting documents (emails, bill of sale, scanned physical receipt of the deposit) My understanding from Kawi Canada there will be a resolution to this situation.

Honestly, what I would do is mention all the "emotional distress" this conflict has caused you and that I'd be considering litigation if I am not fairly compensated.
 
Does your sales recipt have a VIN# on it?
If so, that bike is yours...or the dealer has to jump thru hopps to make YOU happy, not the other waya round.

Maybe. I just wonder because he left money that he still hasn't received back along with a bill that lists the VIN.

Under English common law in Ontario this is considered a contract to purchase and he would be entitled to tort damages.

But given that it is Quebec which is code civil I can't say with certainty how it works when you break a contract.

It is a Kawi Dealer - the biggest one in Canada. Kawi Canada has asked me to reach out to dealer once again so they can provide an "alternative solution", what "alternative solution" can they provide? Its not like they have any more of the models left and Kawasaki Canada doesn't have anymore in their distribution center
 
Just get your deposit money back and call it a day. It's not worth pursuing past that. There'll always be other motorcycles.

I totally agree. I'd go for more in this case. Especially if what they did what "illegal"?
If so they should be offering the world to you and I'd take it and some.

I'm still confused about this being a new or used bike. If the bike is brand new, then isn't the owner Kawi Canada or the dealership? Who is this "owner" that sold "your" bike? Which bike was it? If it's brand new, how are there not any more of these bikes in dealerships?
 
Dude, you have a sales receipt with the vin i'm sure... i don't know if you have a lawyer connection, but i'd look into having that lawyer contact them asking where the bike you bought is....

Without a model number and the price it's difficult to say how hard this will be on the OP. If he had signed up for a $15K bike getting it for $8K and he gets his deposit back he will likely never see the bargain again. While technically not a loss of money it is a loss of a dream. If the prices crashed even lower I'm pretty sure the dealer wouldn't have dropped the commitment from the buyer. Sanctity of contract etc.

I'm sure Kawi has a lot of clout with the dealer and can pressure them when it's time to promote certain deals. It would look good for Kawi to step up to the plate when the dealer gets out of line as this appears.
 
You can't get the bike back, it's sold.

They should return the deposit though.
 
If has been stated this is the largest Kawi dealer in Canada then Kawi isn't going to "push" too hard. The OP can't report the bike stolen as he is not the legal owner of it, he has no registration in his name. He wouldn't even have a case for fraud. He would have a civil case to pursue. He should push for Kawi to honor, (thru the dealership), the contract if it was for a 2013 model then they should be providing an equivalent 2014 model for a similar price.

Let's say the 2013 when it was first released had a MSRP of $10,000 and the 2014 has a MSRP of $11,000 But the OP made the deal for the 2013 for $8,000, then it would be "fair" for them to offer the 2014 for $9,000, (to reflect the difference in the MSRP over the 2013)... Then he also gets a newer model without having to be raped for the increase of say $3,000.

I'm guessing, it was a Concours. In Quebec they get some real awesome sales on "Last years models", so once there gone there gone. On Autotrader, go to bikes then 1000kms area to pick up Quebec. Right now a 2013 Concours is listed at $12,699 + $695pdi =$13,699 out the door.Get that here in Ontario....good luck. Lots of 2014 going for 18,999 in A.T, Snowcity has a 2013 for 15,999, pdi is included. Still there's $2,300 diff., plus tax. It pays to support out of province dealers. Thats sad...This has been going on for more than a few years now, great deals on KLr too.The secret is out....hopefully Kawi dealers in Ontario hear the complaints or see there customers buy esle where.

Its tough to sue in Quebec for pain and suffering after an accident, good luck
getting something for emotional distress! Even then be prepared for a court date 3 years from now
