Unless cops are getting kick backs from tow truck companies and giving innocent people HAT 172 charges to get money from the people who will tow them....

I think thats the trouble with the Law it has immediate punishment that even if you didn't do it you will be stuck with a suspension and impound fees..that you wont get back even if the charges are dismissed.

btw just noticed 172.1 Nitrous oxide fuel systems prohibited, woud that be even if was installed and not switched on , not sure much about it anyway? mainly curious re a sport
car, like a tank in trunk..

Sorry I didn't see your post. I suspect we were posting at the same time. I know that there have been abuses of this law, the obvious example already having been quoted in this thread. I wonder how it would affect the use of the section if the towing and impound were run differently.
 
I just did a solid two hours of practice for the music gig tonight and now I have a while to chill out, so I'll give an example of why cops are c-graders which shouldn't be handed any judgement capabilities beyond the most basic. It's why the constitution/charter was written how it was, but so far the supreme court just doesn't want to give up "powers" that they have claimed (illegally & immorally in my opinion and the opinion of many other Canadians).

So here goes, I've already told this story here a few years ago but I'll regurgitate it:


An ex-employee of mine (now a friend) bought a Sprint ST after riding his 800 Honda cruiser for a couple of years, as he had tried mine in 2007 and really liked it. He still has it, incidentally. Anyway, this employee came to me via a phone call from a local highschool when he was in 11th grade, literally begging me to hire him full-time because he didn't have the money right then for university and they literally had nothing to teach him anymore. Did I mention that this guy had a measured IQ of 170+ in his teens (and some eccentricities as you might imagine)? In the past 10 years he's been all over the world and he works with RIM and other development houses in his role... spent a year in Germany working on Porsche circuitry on contract.

So, back to about 10 years from that when he buys his Sprint. He drops off at his childhood friend's house and shows her his bike and makes some plans with her for the weekend. She takes the car to Costco and he takes the bike, since he is planning on leaving from there and visiting his mother, then us. He leaves Costco, goes into the Petro Can where he fuels up the bike. There's a cop sitting in the parking lot right by the road (this is on #2 Hwy/Princess & Centennial in Kingston). My friend leaves the parking lot on Centennial rather than crossing two lanes of traffic and a double yellow to head East like so many people do, which is illegal (I'm guilty!), waits for the red light and then proceeds, where he does a little weave to "warm up the tires," which is not something I taught him, for what it's worth.

This is where SuperCop blazes into action. He illegally crosses the two lanes of traffic, causing some cars headed West coming off Centennial to jam on their brakes and crosses the double-yellow line, forces some of the cars at the intersection to move and chases down my ex-employee. He pulls over, completely fazed because he believes he's done nothing wrong (and he hasn't). The cop tells him that he was riding erratically and demands a breathalyzer, which he gives him. Then the cop dresses him down pretty good and tries repeatedly to make him agree that he was riding erratically and was not in control of his bike. At this point, his childhood friend arrives and sort of gets involved by asking what's going on. SuperCop erupts in fury and snatches her license too. He goes into his car and sits for ages, running her info as well as his. He gets out of the car and hands her back her license, telling her to "get lost" and then proceeds to tell my friend that he has been charged with HTA 172, just about the time that the flatbed arrives to tow his bike. The cop's told her to buzz off but she hasn't yet, which turns out to be good because now he's going to need a ride somewhere, and back to Ottawa where he lives. They tow his bike and the cop hands him the charges and explains to him that he'll be lucky if it costs him less than $20,000 - then tells him to be more courteous to cops and this kind of thing might be less likely to happen to him. Now, my friend has an IQ that makes most of us look like monkeys, and he does the math in his head about 20 different rebuttals to this utter nonsense, since he'd never even seen this guy in his life before the incident, but comes up with a zero sum chance of getting satisfaction. The bike's already gone. So he shuts up and gets in his friend's car, and they leave.

The next weekend he drops by on the bike after travelling from Ottawa again at considerable expense (rented a car) and tells me about the whole thing. I had wondered why he hadn't stopped by the previous week, but life's fluid like that and I wasn't bothered by it. And he's shaken up, even a week later. I hit the roof, as anyone that remembers the conversations and background I've had here in the past can understand. I was so furious that I almost marched into the chief's office to have it out with him, but he wouldn't have it, thinking it would probably do no good. He was planning to - like most sheep in Canada, sadly - just go and plead guilty with a reason. I told him under no circumstances could he do that, and that he had to put up a really serious; good defense of himself, and involve both me as a long-standing employer and his friend. After he realized that what I was telling him about the impact on insurance as well as his initial fines, he did exactly that. He's not stupid, just indoctrinated like most Canadians into thinking the police or the government are your friends - they are NOT. I gave him a signed statement that he is an upstanding citizen with a tremendous capacity for bringing technology into the Canadian software/hardware industry and that I have never known him to be false or act irrationally. He took it to court and the prosecutor broke. I'd be lying if I told you I remember what he settled for, but it was a minor HTA offense.

So there you go. That's why you don't give cops this kind of power. They're mostly vindictive, aggressive individuals with a poor sense of fairness and many of them love to swing their d!cks whenever they get a chance. Imagine the damage that idiot could have done to a Canadian who probably makes millions of dollars for several companies, based on his knowledge of software and circuitry that few people could ever grasp. All because he was feeling petty that day... maybe he hates motorcycles. Whatever.

That ate up 20 minutes. Time to go get some food and go downtown for setup & sound check.

TL;DR: cops are the kind of jerks that will abuse HTA 172 for their own sense of control, and my extremely talented ex-employee got a HTA 172 for nothing, then went to court and beat it; cops should never be given this kind of power

PS: It was Cstbl Millner, well known in the area for being both a bike rider and also a biker hater. Figure that out. He used to cruise into coffee shops and start up conversations about what speeds we were "getting away with" on the back roads. Like we didn't know him... thankfully he retired a year or so back.

I got pulled over today and was warned that I was "going too fast". I asked them "how fast was I going?". They said "If we had you on radar, we would give you a big ticket".

I was in 2nd gear in a 50 zone, probably making too much noise, so they thought it was faster than what I was actually going (traffic speed). After giving them my stuff, they told me to go, and followed me for a good 5 minutes and even into the plaza I was meeting my friend in (who was ironically with firefighters at the time).

Cops, by large, are pieces of inbred ****; the inbreeding would explain why they're all so similar. I do not want my taxes to be used to pay little ***** that try to intimidate me for no ****ing reason. I guess I'm lucky that my scenario didn't end up like the way your friend's did.

EDIT: Forgot to mention the cop turned from the right most lane to make a left turn to siren me. He was following me for a while and I gave CLEAR indications (signal, blind spot checking) that I was turning LEFT so that if he wanted to follow me he could do so safely.
