It wasn't a bike issue but years ago a neighbour had their canoe just laying in their yard and we got one of those mini tornados. The canoe got picked up and slammed against our car. Did about a grand in damage IIRC.
Stupidly I agreed to put it through my comprehensive and he was going to pay the deductable. He reneged and I got hit with a premium increase next time around. My accident forgiveness didn't apply.
I now have zero tolerance on this. You damage my stuff you either settle immediately or I call my insurance and file a claim.
I haven't let the rules of determination sink in yet so I would also look at those before making a scene. I was under the impression that if a vehicle was stationary it couldn't be liable. That appears to be subject to interpretation.
Went to the collision reporting centre. The police said that my neighbor had been there just before and admitted being at fault and said that she felt really bad about what happened. Called my insurance company and submitted the claim. they have confirmed that I am not at fault and my deductible will be waived. Just waiting for an adjustor to come view the damage. Unfortunately they said this may take up to another week.

Personally, i'd still give her some flowers or something to let her know there's no hard feelings. Sure it's a bit much I think considering she's at fault, but hey, when you're living beside someone, you don't want to make **** relationships.

Collisions with neighbours are always trouble. My wife "scratched" the neighbours car and we paid to fix it. The lady was decent and got a few quotes and let us pick between them(Maaco is about half the price of a dealership). We gave her a few hundred more than the quote in recognition of the hassle. Things are still civil. If she'd forced the dealership quote, things would have been more complicated.
Where I have been the receiver of damage, sometimes I just take money for depreciation and don't fix it. Ie. the damage is $3000 to fix properly, the bike is only worth $4000 before the accident, give me $1500 and I will still have no problem selling the bike for $3000 when I get rid of it. Everybody wins (obviously scenario can change drastically depending on values involved).
They gotta pay? Yes and no. The neighbour admitted responsibility... insurance gets in the picture, and then it is up to them to determine who is at fault. The adjuster will use the Fault Determination Rules - Regulation 668 under the Insurance Act (R.R.O. 1990, Reg. 668 )
Let's take a look at section 17 for parked vehicles:
17. (1) If automobile “A” is parked when it is struck by automobile “B”, the driver of automobile “A” is not at fault and the driver of automobile “B” is 100 per cent at fault for the incident.
(2) If automobile “A” is illegally parked, stopped or standing when it is struck by automobile “B” and if the incident occurs outside a city, town or village, the driver of automobile “A” is 100 per cent at fault and the driver of automobile “B” is not at fault for the incident.
I guess the question is... was the motorcycle parked "legally" or "illegally?
Worst case scenario, the motorcycle is at fault 100% ...
OR the adjuster cannot determine it, and dings both parties (50% each). Everybody loses (edit: everybody except the Insurance company)
Steve Kee, director of media relations with the Insurance Bureau of Canada, adds:
By law, any collision where damage exceeds $1,000 must be reported to police. You should also report any collisions to your insurance company.
Insurance fault determination rules apply even in parking lots. If both vehicles were moving, it’s 50:50. If the impacted auto was stationary, it’s 100 per cent on the other driver.
