Hit and run question

A few weeks ago a friend of mine got her bike backed into and damages include nearly all fairings broken and bent forks.

Currently, we are very close to finding this individual, if the individual is found, what legal options are there? A police report was filed. Could this still go through insurance?
 
If you have the license plate number from the accident, (especially if it is from an independent witness or camera), insurance should have no problems with the claim. If you are trying to say that the silver civic that passes every day at 8:27 is the same one that hit your bike, I wish you luck.
 
All you need is a plate number to go through insurance, as far as I know. Up to a year to make a claim in any situation (unless that has changed recently).

You might need to fight if insurance calls them and the driver says they have no idea what you're talking about, though.
 
Yes, you can go through insurance. Insurance is designed to cover an incident such as this. If you don't have the other person's insurance info. you need to have collision coverage on the policy and you pay a deductible. As always, it's best to consult with your agent/broker.

Thank you, if this is true then it is key. I know insurance will try to get the police report, and all information we have found has been forwarded to the report. We need to find that person and their license plate though as the security tapes fail to show the plate.

Lets say you do find an identical car just like in the security tape, how will you prove that its the same car?

I wish you luck finding the guy.
But as written above, you do not have play detective and find him / know who he is, to start a claim. At the very least, start talking to your broker about your options.
 
You're going to need at least one credible witness with an accurate and clear description.

The footage shows the guy getting out of his car too, there is no frontal shot which is the only problem. From the videos there are MULTIPLE witnesses....just need to find them too. What a pain in the ***.

Obviously. The problem in these hit and run cases is first finding the person and then when you confront them, they deny any responsibility or knowledge.

I'll let you guys know how that goes if we find this person.
 
The fact that you posted on a public forum that you have a vendetta against this person will not help your chances.
Personally I hope you find the sob and the witnesses that you need to move forward.

Then they would be looking for the driver because that is a leaving the scene of an accident charge.

hahaha. Property damage is just about the lowest priority. They take the information for the report and in most cases, that's the end of it.

Well I am going from two incidents that I was a party to.
They both happened on private property.
The person wanted to leave without producing contact info and the Police officer on the phone said to tell them they will be charged with leaving the scene of an accident.
It was just minor fender bender in parking lot.

What else would you expect an officer of the law to say? You also had witnesses.

I already knew the police would be kinda backlogged (ie. not very helpful) but told the victim to continue to pester the police weekly with new information since she reported it day 1. The fact that there IS a report might be helpful I think?
