Help With Scala Q2 Pro

I bought a Scala Q2 Pro, I've had the regular Q2 for some time now and was very happy. I ride with earplugs and the audio volume of the Q2 was perfect. I wanted A2DP so I got the Pro version. Works flawlessly with my iPhone 4s, the only problem is the volume auto adjusts DOWN. I put it at max and it lowers the volume down to mid volume. With earplugs its not usable :( My assumptions of Auto Gain Control was that it would increase volume UP with speed/noise and lower it back down to the volume you previously set, which this does...but honestly I need to travel well beyond the 401 posted speed limit for the volume to raise up and then its clear, as soon as I slow down to 120km/h the audio is back very low.

Anybody else have the Q2 PRO, can confirm this is normal behavior?
 
On my G9 that is adjustable on their website-thing.
 
Cardo is going to send me a new unit, hopefully this works. The Q2 has AGC and it lets me put the unit at MAX volume without it lowering it. It does not make sense EVERY AGC system I've ever had let you set the volume and then it would increase as vehicle speed/noise increased if possible. Seems like they have AVC where they try and determine what volume is best for you, but really that's not exactly what I wanted. Wouldn't have been an issue if I had bought from a local shop, the pains of buying online they don't want to take any returns on anything that has been used.
