Help - Crazy Story - Caught my neighbour kicking my bike over

Hi Guys,

Last night was insane. My neighbor is this creepy 40 year old who doesn't work. He has always disliked my roommate and tries to harass us. He says we walk too loud and slam our doors on purpose (it's a townhome so you hear everything). My roommate has gotten in numerous fights and called the cops on this guy repeatedly but nothing that warants more than a warning.

Anyways - Last night I came home in a rush and closed the door (again it's a townhouse and our walls are the same and he heard me come in). Literally this guy starts ringing and slamming his fists on my door. No way was I opening that door to a crazy person but a second later I hear a huge slam. I run outside and this guy has kicked my bike over....

My bike is completly ****ed - Cops came and actually arrested him because he left a footprint on my bike!! They matched it to his shoes right away. We have to go to court now but I'm stuck with a leaking bike on my driveway. Any suggestions what to do? When I call insurance will this still come out of my pocket? Also - I'm in Markham. Who should I get to tow my bike/where to get it fixed. How do I even know if it's worth fixing?? It sucks because I said I paid $1000 for the bike to pay less tax....I hope it doens't hurt my claim.

If anyone has dealt with a similar situation please give me any insight. I've only had my bike for 4 months now. :sad5:
 
You can claim it as vandalism if you've got full coverage. It won't increase your rates but I think you still have to pay the deductible.

Crappy situation. I may be mistaken, but you'll most likely have to make a comp. claim on with your insurance company. Not sure if the neighbour himself is covered in any way. Other than that, you're likely looking at a small claims court action to recover costs.

Do you have a written report from the cops? If so and you're covered call your insurance company

Insurance will count it as vandalism. Depends on what coverage you have if they pay or you pay.
 
How much is the damage?

Start reading and learning about small claims court, you can sue another person up to $25,000
Start thinking about moving out, you don't want to live next to this guy - he may do it again, to your car, yourself, etc. Sounds like he has absolutely nothing to lose.

Now, why did he do it? Was he on drugs? Get the cops to look into it.

What you wrote for the purchase price to the MTO won't hurt your claim. I put $1 and paid $0.13 tax and when I wrote my bike off the insurance company covered it in full.
 
Holy crap, sorry to hear man. I'm in Markham too and people are generally kind here. =/ Neighbours suck.
 
It might actually be covered by your homeowner's insurance because it was in your driveway.
 
What you claimed you paid for the bike has no impact on what you get reimbursed for if its a write off - insurance companies will pay you the money that is required to buy a similar bike on the market now to replace yours.
 
Have a cruiser biker party at your house.
I am sure some of the HA looking types can stop by and offer your neighbor a beer and a few positive words.
Go put some felt between the door and door frame to stop the noise.
Problem solved.
 
not sure if you're still gonna bother fixing it, but since you're in Markham go to Fawaz and Speedworx. He's located on Heritage road, right across Markville mall. The dude is proper and one of the nicest guys you'll meet.
 
It might actually be covered by your homeowner's insurance because it was in your driveway.
Nope. Even if your motorcycle is in your garage and your house burns down, not covered by your home owners policy. Bike = covered by bike policy only.

EMS - believe the gents name is Brent or Brian (I'm horrible with names) we had to use him Sun when one of my buddies low-sided (he's fine he walked away from the incident). Really cool guy.
