You've mixed up (some) ranks with titles.

It is a formal title, separate from rank. It's akin to military jargon of there being a commanding officer or CO. Even though this can range from full colonel to say lieutenant it is separate from rank.

It's not illegal to ask. I frequently find this situation gets reported with bias both ways.
