They are being treated differently because they aren't a motorized vehicle, they go extremely slow. With a governed wire, they top out at 32 km/h- barely enough to get a breeze in your face and 49cc scooters go...
I see a lot of bikers following too close- I use to myself. First train of thoughts when I ride is always having a opening, a spot I can get into if I need to avoid danger.
+1 on the DRZ 400 S(M), I would say if you decide on the DRZ go with the SM model because it has inverted forks. If later on decide you want dirt tires, it'll be cheaper to get a set of rims/tires then inverted forks.
