I'm thinking he gets 5 yrs, 2 for 1 time served,by time he is sentenced it will approx 6 months, therefore 12 months, then he serves 2/3 gets out on good behaviour. That scenario works out to 38 months served total.

Unfortunately he's not charged with murder.

I think with time served his total time spent in jail will be 3 yrs.
