The following is a shining example of why, you MUST advocate and fight for yourself, (no one else is as nearly invested in the outcome as are you). As many will recall I was involved in a fairly serious, (in terms of injuries sustained), collision as a result of being hit by a flying attacking goose. Fast forward almost 3 years.

I won't/Can't go into details as this will likely be the subject of litigation. I was advised that the testing done has shown that I suffered a "traumatic brain injury", Exact words from the specialist.

Bottom line if not for my continuing push and insistence, that something was amiss, It NEVER would have been sufficiently, (and as now proved by the scan), been detected.

Now my hope is that due to the excessive period of time is there still a good prognosis to correct this "substantial injury", again the specialist term NOT mine.

Only time, which with insurers involved will move at a snail's pace will tell. So DON'T back down if you KNOW there is an injury advocate for YOURSELF.
 
Good luck with your recovery Hedo. Insurance companies are the worst. They just keep pushing and hope you die before they have to pay what you are owed.
 
Thanks, but as I have always maintained to my lawyers and then to the insurer. To me MUCH more important is the treatment, any settlement is secondary on the list.

Agreed. I didn't word my statement very carefully. In scenarios where people are actually injured, the vast majority would be happy to have no settlement money if it meant they could be back to pre-accident health. In practice, this often means settlement money is given and then the patient hopes that its enough to pay for the required care/treatment.

too many accident victims don't have the ability to advocate for themselves
the Ins Co's take advantage of this of course, good for you in sticking with it!
 
Agreed, the insurer, has built their business model, on most simply giving up. I can say, via the last several years, I have learned MORE about the insurance industry, the rules and regs, that the Government has allowed them to lobby for and institute, (which even now at times surprises and astounds me).

But, unfortunately, (for them), I was copper back when you actually LEARNED legislation, and how to apply it, and how to argue effectively, against it..lol

At times, people look at me and I can tell they are thinking wait HOW do you know that...lol

I am also fortunate in that I had as clients, (insurance mediators, rehab specialist, brain injury specialist, etc etc etc. So EVERY opportunity I get I ask questions and often get GREAT helpful advice...

Not everyone, has those things at their disposal, and as such can't advocate effectively.

Keep up the good fight Hedo. Countless others get rolled over by the industry completely in the dark and without any visibility.


My mother spent years dealing with two insurance companies battling out the percentages of any settlement. And that was after years of dealing demonstrating her injuries were not pre-existing before the accident she was involved it.

Thankfully the law firm she had confidence in her case and fronted the financial support for her recovery until the insurance companies could come to an agreement. It was almost a decade to go through.
