Question on (increased) fines for using electronic hand held device while driving

Now that the fines have gone up to $1k for getting caught while driving and using hand-held device, how does the accused prove s/he did not have one, to begin with? Does the officer make a note of the device? Otherwise, wouldn't a defendant just say, s/he had no device at all, at the time of...

    Helping police incognito

Thanks for the responses! Good to know. Regarding the BMW story, I do not condone such acts, but there are times ... I remember crossing the street at a designated/marked pedestrian crossing, when I saw these two women in a bimmer. They wanted to make a right turn, but didn't bother waiting...

    Helping police incognito

You walk, seeing something suspicious on a side street. Less than five minutes later, a police car passes along and you flag them down, telling them what you saw. They go in the direction you pointed and make a couple of arrests. You leave. Can you be then tracked/called to testify against...

    Disobey Sign Ticket

Can you explain what you mean by "reduced to by-law"? As in, will it still show on your driver's license record? Thanks!

    S/he did it too!

Would your answers change if the other first vehicle was a marked police cruiser?

    S/he did it too!

    Fair enough.

    S/he did it too!

Thanks for your replies. I get that officers have discretion. But, considering the officer was at a "look out" spot for HTA offenders and that there was no unusual/exceptional circumstances to let the first driver off, it seemed to be an arbitrary decision. Not sure "discretion" is that broad...

    S/he did it too!

Video disclosure shows another vehicle doing the exact same infraction a mere couple of minutes before me. The officer did not charge the first driver but did charge me. Any merit to raising this issue at trial? Thanks.

    11b question?

I appreciated the information posted by iFly55 as well. Thank you! :) I don't think I understand the intake period too well though. I am referring to that 2011 Andrade case that you posted. If you do the math, it goes something like this: (1) Andrade: -2 months (inherent time requirement...

Texting while driving could lead to $1,000 fine, 3 demerits

Grapevines are grapevines. If 75% of fines were paid outright, then Toronto wouldn't have to open FIVE new courts just to handle the volume of contested tickets. Just saying. But then again, I also hear things through grapevines, so I could be wrong. p.s. thank you for the helpful...

Texting while driving could lead to $1,000 fine, 3 demerits

Folks, some of you are looking at this from the wrong angle. I, for one, welcome the increase of the txt/drive penalty to $1,000. Why? B/c it will prove itself to be a bad idea overall. A large number of people already take to trial $50-$100 tickets b/c they don't want their insurance to...

    Parking Tickets, Toronto, General

I read something that until 2009, Toronto would not prosecute the majority of $30 parking tickets, b/c of insufficient resources (these are low priority). Since then, they opened up 5 new courts. Anyone know what's the current status? Is Toronto seriously taking to trial $30 tickets now?

Guilty plea v. conviction - any difference?

As per title, is there any difference between pleading guilty to a HTA offence as opposed to fighting it and being convicted? I know if you plead guilty you will pay less and get fewer demerit points. But other than that, is there any real difference between pleading v. conviction?

Got the video disclosure, what now?

I am not the OP, but yeah, I think the video was likely taken by the dashcam police cruiser, since he asked for it.

Got the video disclosure, what now?

Okay, I see. The only reason I asked is because some jurisdictions are more backed up than others, or used to be. I heard rumors that certain jurisdictions (cough cough Toronto) threw out all these past tickets, just so they could catch up with the workload. Which means no more 11b. excuses...

Got the video disclosure, what now?

dragonrider, did this happen in Toronto? If so, which court? When did you get the ticket and when's your trial? I saw some thread on this site talking about if you had to wait more than 10 months, then you can bring some delay notice.

    Toronto East Court feedback

Thanks for your input, Red; you are partially correct. Provincial prosecutors do not have to be lawyers (you are right) but they have to be at least paralegals. I know some paralegals who work for the City of Brampton as prosecutors and all of them have been licensed by the Law Society. My...

    Toronto East Court feedback

Thanks again. At my resolution meeting, they only provided partial disclosure, telling me that I have to request a "special disclosure" for the remaining materials. I was offered something similar to Abid's comment above. Found it strange, so I'm going to trial... What is really weird, is...

    Toronto East Court feedback

Thanks for your input guys. I'll see if they produce disclosure in a timely manner, or if the cop will show up in Court. Justin, how reliable is your source that Toronto cops now get paid/required to show up? And 6 months before it gets to trial? Jeez...

    Toronto East Court feedback

Hey everyone, I'm new to this site. Got ticketed last month for allegedly disobeying stop sign. Requested early resolution which I received a reply to surprisingly fast telling me it will be in July. I will have to attend Toronto East Court. For those of you that have experience with the...
