    Fault in this scenario?

Update for closure: My adjuster contacted the other guy's insurance and they were not aware of the incident. My adjuster decide to proceed with no fault against me, reason being the other guy had a stop sign. Thanks for all the comments. Cheers

    cellphone ticket?

Legally, it may not be cheating the system. And I'm all for fighting your tickets. If you read the rest of my post, you would see that I suggested you go back on a similar day and take pictures to see if you can catch glare. In fact, I just came back from the courthouse yesterday. My officer...

    cellphone ticket?

I'm not a police officer in case you're going to ask, but DownUnder does raise a good point. The law is what the law is today, and you did break it as you've admitted yourself. Now, regardless of how we may feel about this law being fair or too overreaching, let's be honest and admit that what...

    Fault in this scenario?

Yes, police report was filed the next day. The other driver was actually the one who insisted on it. Also have photos of collision. Thanks for all the responses; feeling less worried about the risk of going through insurance now. I'll post back when it's settled.

    Fault in this scenario?

There's a patch of paint scraped off the corner of my bumper. Just cosmetic damage. His car, on the other hand, scraped up some of his back door and quarter panel. Also a bit deformed around the seam of the door.

    Fault in this scenario?

Thank goodness I was Car A. The other driver got out and said "look what you did to my car! But I'll make you a deal if you don't want to go through insurance..." LOL My only concern was whether I could be somehow partially at fault in the eyes of my insurance company and be responsible for my...

    Fault in this scenario?

Regarding the pedestrians, there's this sentence at the beginning of the fault determination rules document: "3. The degree of fault of an insured is determined without reference to, (a) the circumstances in which the incident occurs, including weather conditions, road conditions, visibility or...

    Fault in this scenario?

Hi folks, hoping you can provide your opinions on determining fault in the following scenario... I looked through the Fault Determination Rules document here (thanks VifferFun): http://www.ibc.ca/en/car_insurance/documents/brochure/on-fault-determination-rules.pdf I didn't see any sections...

Partially at fault (and deductible) scale

Thanks for your responses guys. I looked through the Fault Determination Rules document you provided, but I don't really see any situation that applies in my case. Perhaps I will make a new post for help with determining fault in my scenario. Thanks again

Partially at fault (and deductible) scale

Hi everyone, I've got a question about partial fault and how that affects one's deductible. I called my insurance provider (TDMM) but the person on the phone wasn't positive on her answer. So first, my understanding is that the amount of deductible one must pay is directly proportional to the...

    Officer's notes - wrong colour

Just to clarify a couple things: - I was pulled over in my car, not bike. - I am not white. Regarding silver vs. gold, I will definitely try to pursue this angle. But as a couple people have mentioned, silver could be mistaken for gold under yellow streetlights. Personally, I would not be...

    Officer's notes - wrong colour

Thanks for all the interesting and insightful responses. Lots of reading for me to do yet. iFly's comment that, essentially, a lack of action could imply willful acceptance is definitely something to consider...

    Officer's notes - wrong colour

I do have disclosure; a single page of the officer's hand written notes. The notes say "Laser Atlantis <model #> all in order". No mention of testing times. Coyo, you're saying he could have his testing times noted on different pages in his notebook? If I begin to ask about this and he...

    Officer's notes - wrong colour

Yep, that's what I figured as well. Silver and gold would look pretty similar especially in yellow streetlights. Any thoughts on the (lack of) LIDAR test times in the notes?

    Officer's notes - wrong colour

Hi folks, I'd like to hear what your thoughts are on a speeding ticket if the officer wrote down the vehicle's colour incorrectly in his notes. I read the FYST website briefly and I see that there may be grounds for dismissal if the colour is blatantly wrong, e.g. blue vs. red. But something...
