Re: Claton Rivert death and Questions Swirl around SIU investigation.
Pedestrains are not the best of examples. They do not have lights, do not travel at 25km/hr, and are not a vehicle by law. It's a whole 'nother ball game with them. Pretty much you hit one, better be prepared to lawyer up.
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Really? The SIU reports their findings of their thorough investigation with "It seems"? As a former police officer this appears normal and reasonable to you?
And yup. That's me again on how the SIU can report as to the...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Ya I know eh? See bike don't pull out.
Didn't see bike-Find a safer place to make your move.
Can't wait until we get to debate how the SIU could possibly know the intent of the officer was to turn around, without a...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
I knew exactly what ya were sayin. Im not gunna hold speeding against anyone here though. Only if they say they never have.
And yes what we and you say does matter. It's our thoughts/beliefs/actions/votes that may have an...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
We have all done it, and shouldn't complain too much when we find ourselves defending our actions in court.
A generally reasonable person can make unreasonable decisions on occasions. All of us here have been unreasonable...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
I was maybe 50% over or so in a 50 or 60 zone. I was accelerating hard from a light with a loud exhaust. All eyes were on me because of this. I was acting irresponsibly. The other vehicle came out of an alley close to the...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
We have already agreed on Clay's actions. We all agree Clay was speeding/stunt driving. It was just about the only part in the SIU release that wasn't vague/fluffy/irrelevant.
Re: Claton Rivert death and Questions Swirl around SIU investigation.
But you surely wouldn't pull out in front, based on your own experience of being unable to judge speed in similar situation?
Re: Claton Rivert death and Questions Swirl around SIU investigation.
I said guess that they were speeding. Not a particular exact speed.
Example for clarification, "Wowzers that motorcycle is movin damn quick, I would be foolish to place my vehicle in its path" not "Hmm. That motorcycle...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
That's a good read Rob. I still believe a reasonable person would have been able to tell the motorcycle was speeding.
As a reasonable person yourself, do you believe you would have assumed the motorcycle was traveling at...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
I could go back and create my own and your summary of positions too. There was plenty omitted and some spin involved. I won't allow myself to act that way.
I am not well spoken when it comes to law, and this is not a...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Why would one have to guess speed to such accuracy before pulling out in front of them? At that speed, yes, I believe that a speeding motorcycle would be quite obvious to someone who saw it/looked/used their head. All the...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Considering the minimum turning radius of the car, the speed of the car, the time to complete full turn would be about 5.5 seconds. (That math hurt my head).
The car did not complete Uturn in that time.
If there was a...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Sure it does. A reasonable person would certainly be able to know that the motorcycle was speeding if they saw it/looked/used their head.
If unsure of speed, to pull out and hope for the best is a very poor choice.
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Hedo do you really need measurements to know that a 40' turning radius would put the officer behind the wall? Really?
Legally speaking driving through cones and behind a construction barrier is simply considered using the...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
This incident does not involve getting rear ended, drunk driving, gambling, long country walks, or baby carriages.
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Curb to curb turning for that car is approximately 40'.
A UTurn on the usable portion of the roadway was impossible.
Officer would have had to left the road and gone off highway into the construction zone.
This would...
Re: Claton Rivert death and Questions Swirl around SIU investigation.
Nobody got rear ended here. If the officer had of been rear ended, I would have to believe the officer was 100% not at fault.
