Passing on the paved shoulder, probably same thing. White line - no, yellow line or no line - sure, with caution, observing the signs.

I'm sorry... But what's the difference between "you should not pass", and "you may not pass"? Aren't they the same thing? (At least in regards to law).
I mean yea, you can always do whatever you want, question is if you'd be challenging the law or not that ways.
