There has to be another way to deal with this guy. At what point do the officers disengage? Is selling illegal products worth discharging a pistol into a crowd? I would suggest no. I think the officer is at fault for the discharge, hands down. And the other guy is obstructing police. Justified use of force? Definitely not.

Dude got shot trying to grab the officer's weapon (spray)... if that's not justification for shooting him I don't know what is.

The flip-side is that they should've probably disengaged long before it came to that. I'm no cop, but if myself and 2 partners are slowly being surrounded by an angry crowd, it may be time to take a walk.

Someone attempting to assault a police officer, while he's already engaged with a suspect, seems to be a pretty good reason to discharge a pistol at that additional suspect when less lethal means have already been tried, and have failed.

The use of force at that level is justified when presented with serious bodily harm or death, which I don't think is present. The second suspect is displaying assaultive behaviour, which equates to the use of an intermediate weapon, like a baton, spray, taser, or hands on approach.

If it were me, I would probably have disengaged a while ago. But, I would much rather charge the person attempting to disarm the officer, than the person who didn't pay the tax on whatever it is he's selling.

Too bad warning shots are prohibited, that seems to be the only thing that really worked.

It would've been present had the guy managed to grab hold of the cop's spray.

Very dynamic situation in any case. Considering its hard to judge even based on video after the fact, then I'd say the shooting would've been justifiable in the particular moment.

Fair comment. Their guidelines may be entirely different. I can really only speak to what's in place here, and speculate on the rest. Here, spray is intermediate and would not meet the criteria for serious bodily harm (or death, unless an allergy to pepper is present?)

I don't know about you, but I'd be mighty worried about that spray being used against me while I'm also holding a pistol which would most probably be the next thing I lost. Scary predicament.

It becomes a liability at that point. And let's be real, if a perp approached a cop with pepper spray he'd get shot anyway.

I think anyone who survived this is lucky. SOP in Brazil is dump the kid in the trunk and cap him in the woods. Cops will probably be back for revenge, pick people up that they recognize one by one.

Really Buddy? Why would you try to grab something out of the hand of a Police Officer that has their service revolver unholstered? In all of my dealings with the Police it has always been"yes sir, no sir". It must be easy being you. I bet you probably would not have been any more comfortable then those officers if you found yourself in a similar situation.

News from Mexico: An army officer and seven soldiers face disciplinary action for their participation in the killing of 22 people in rural southern Mexico - read it carefully: 22 unarmed people killed in cold blood after they had surrendered to the soldiers.

Motive: unknown. Apparently, it was just for kicks.

Now, back to Toronto Canada: what abuse are you talking about? An officer gave you a parking ticket?
