Don't lawyer up, it will get costly probably as much or more than a relocation cost.

Have and HVAC technician come by your house for an estimate and see how much relocation would be to run lines along the side of the house to the back and just pay for it to get your sanity back or just don't open your window at night.

When we bought our townhouse, the AC was located on the rooftop patio just above the master bedroom and that goes with every other townhouse in the complex and we can hear our neighbours and even two neighbours down but not as bad. Problem is that there is not a single thing we can do about it, you grow accustomed to it. We have an air ionizer which we run at full blast when we go to bed and the white noise is soothing to say the least.

The problem with my situation if I run my AC it resonates and we can either move it or install a ceiling fan and hope that it helps.

Let me paint you another picture, I don't live too far from the rail line the trains don't bother me at all, when my bedroom starts humming like a semi is parked outside idling it's engine....that bothers me. Capiche? If that sort of thing doesn't bother you I'd suggest you have a serious CNS problem.
 
To be honest, I only read your first post and made the decision to side with your neighbour...
It reminded me of a family that moved in next to a dairy farm then started complaining to the authorities about the stink...

Fair enough but it's not like that...most people who see and hear the problem wonder why the tard ever put it there in the first place. I'm not a whiny, grumpy old bastard, type of neighbour. But I do think that as a person I'm very reasonable....this situation isn't reasonable but there is a very simple fix for both of us but he won't move it so far.

My neighbor right behind me, built my rear fence (5 of us paid for the materials), my left side neighbor built my side fence (I bought them both the paint for them to paint their side as well, we all get invited to each others house parties). I do both of their side walks during winter while I do mine (I have a snow blower and they don't), guy behind me just bought a snow blower this past winter so now he does my side walk when he does his and I do both of ours when I do mine.

It is all about give and take and be nice and considered from the beginning. Brooklin is awesome

Similarly, if the offending party was a pervert but the other neighbours tolerate him is it OK for him to fondle your kids and peek in your windows? Maybe to be sympathetic you should leave a cold beer for him on the outside windowsill. Wrong is wrong.
If he stays on his property I'll tell my kids to stay off his and away from him and get some blinds.

Or the people that move onto high speed streets and then lobby to have the limit dropped.

Neighbor does sound like a bit of a dick, though.

I don't understand why people live close together and then complain about the noise. Well no shat sherlock things aren't going to be quite. I bet you'd be happier out in the country.

No different than why people live on a road like forks then ***** about the bikes and cars. You knew they were there long before you bought. If you don't like it don't move there.
 
I'm pretty sure I would have cut the copper refrigerant lines by now.

Rest of the neighbours are brill. Had them over for dinner this past weekend. They are all reasonable people and so am I.

I just want to go on the record as having used brill quite recently, I think in response to a FullMotoJacket touring suggestion.
 
inreb sometimes you piss me off but when he posts at 3:49am re the noise from a neighbours air conditioner and you post that it darn near made me rotfl. But I do feel sorry for the guy

I'm glad you enjoyed that one. I know I'm not to everybodys' taste by all means confront me when I need be set right. It's not a problem.

All that blathering I did re: DR650 known issues was no harm meant.
 
Actually if you read some of the posts made by the OP, it was measured and apparently it's just a bit over the legal limit of where it should be, that is if it was measured correctly, then again if By-law was out there and on several occasions, I am sure they would have measured it and written an order of compliance to have the unit moved, I have to wonder why this was not done...


But I am curious on one thing OP, you say he is in contravention of a "Noise By-Law" really ? where is this By-Law, I don't think I have ever heard of a noise By-Law being used against an air conditioner.

Can you point this out for me in the By-Laws for your City
