Obviously not a professional, he's not very accurate with the hammer.

Maybe he attacked the car and not the driver.....news reports can be misleading.

Hopefully the cops figure that out before laying inappropriate charges, one is assault the other is vandalism.

Attacking someone's car with a hammer while they're inside... is not vandalism.
Attacking a person with a hammer.. is much worse than an assault charge.

Like I say, sure hope they figure it out before laying inappropriate charges, they already issued a statement that was publicly reported with some uncertainty.

"attacked the driver with a hammer"<- there is only way to read that unless they actually said 'attacked the car with a hammer' and were subsequently misquoted.

Under the law, "attacking a vehicle" while occupied is still considered an "attack on the occupant." Just as in the case of using your car to ram another occupied vehicle. The appropriate charge would be assault, unless of course the occupant were injured or killed then it would escalate, to dangerous driving causing bodily harm or death. It more about the "intent" than what actually occurs.

One can be charged with assault, in Canada, under the Criminal Code of Canada, merely by "verbal assault", so a hammer would meet the test.

Exactly what I was thinking. Some bikers carry hammers to smash the window of vehicles they think are misbehaving. Either the police or the woman driving might be sensationalizing.
 
Hedo just explained it why they called it an assault even if it was just the car that was attacked.
 
FYI...

The car driver probably would have been justified in running over the biker to get away from the attack.
 
Does this mean I need to have a pointy stick while driving in Toronto, to hold off hammer wielding bikers?
 
Fleeing the scene of a possible assault is probably detrimental to one's credibility. Deciding to carry a hammer around for "defense" while riding a motorcycle would seem to indicate poor judgement. Hopefully someone can locate the correct self-incriminating YouTube channel.
