Left turning m/c collides with SUV driving thru yellow

Found this on RFD. Hwy 7 / Hunters Point Drive. Sunday August 13th 10:24pm if the clock on the dashcam is correct.
 
MC rider is just as at fault as the SUV driver IMHO - you can't just blindly proceed through an intersection across traffic assuming other cars will stop, especially when the light is still yellow.
 
Isn't that supposed to always be the other way around?
MC should be at fault, way was not clear to make the turn.
 
Agreed, from the letter of the law (& insurance determination) the MC was basically 100% at fault for turning into a lane that wasn't clear, but.... the light turned with MORE than enough time for the car to stop before it went red, but the car made zero effort to slow down or stop - the light would have likely turned read on him while he was in the intersection even without the collision which would have placed some of the fault on the car.

Either way, stupid move on behalf of the MC - never just assume or trust that crossing traffic in this situation is going to stop - I *always* assume cross traffic is either going to not stop, or turn.
 
The way I see it is, the MC would likely be deemed at fault and charged.

HTA 141 (5) No driver or operator of a vehicle in an intersection shall turn left across the path of a vehicle approaching from the opposite direction unless he or she has afforded a reasonable opportunity to the driver or operator of the approaching vehicle to avoid a collision.

Hurt physically and then dinged on top of it.
 
rider screwed up....cannot take right of way, only give it
lucky it was a relatively slow speed crash
not talking about the law, more about defensive driving attitude which keeps you alive
 
Even braking and the collision, the SUV cleared the intersection before the light turned red. Nothing to blame on the SUV. It had clear right of way. It even tried to brake and avoid when the bike came barreling toward it.

Looks like a CBR250? New rider?
