Yeah you can't refuse a breathalyzer test here. You might as well blow it, just in case you're in the warn range. Worst case, you can try again and hope you're in the warn range.

For what it's worth, in the United States they have roadside blood tests. Judges are literally onsite writing up roadside warrants to get your blood. If you refuse, yes... you'll get strapped down and the blood will get withdrawn forcibly.

At least that doesn't happen here in Ontario.

Our wonderful Federal Government, who spend so much of our money telling us what a great job they're doing, were pushing for roadside blood testing not so long ago. I believe that the opportunists over at MADD were behind it.

They are the same charge, but are two different contraventions of the HTA section 216. (2 and 3)

Failing to stop for an officer could mean that you blew by a DUI checkpoint or a speed trap. The second one is "Escape by flight" and is when you willfully flee from police when they have given chase.
