Quebec driver who stopped for ducks guilty in fatal crash

All she had to do was pull off the higway. Who the **** stops their vehicle in the left lane of a freeway intentionally (and with no hazard lights on, no less).
 
Can any of you seriously tell me that you'd stop your vehicle here for some ducks?

If my car broke down and I was forced to stop in this position on that road, I'd be crapping my pants the entire time. This is suicidal.

Mind that the car had to be more into the lane prior to crash in order for her to get out of the driver's side.
 
So the car is expected to plow through the ducks, possibly damaging their car. Ok, I can accept that, since there's 4 wheels, chances are that's the most prudent thing to do. Now what if a motorcycle faced such a hazard? It's clearly *less* safe to try and squash some animals with your 2 wheels.
If it's unavoidable, you're far better off trying to hit the animal straight on than stop in a live lane with traffic behind you and nowhere for them to go to avoid you.
 
Blocking position should be the the right track of the left lane though, no?

on the other hand, what if the vehicle had a mechanical failure and stopped? Following drivers are supposed to leave safe distance and speed to stop in an emergency..of course, no one does this.
If you have a mechanical problem on the 400 North, you are as good as dead, because one-hand-on-the-timmies Dougie in his F250 is coming up at 150.

I know right, if a drunk driver hits and kills someone who was speeding, they should be off the hook!

The position of the car in that photo isn't the exact spot in which she stopped. My guess is she stopped entirely inside of the lane because she had room to exit the vehicle.

Imagine not only stopping your car there, but GETTING OUT?! Holy jebus. As far as I see it, a little bit of prison time is the LUCKY ending to her situation.
 
Driving up highway 17 to the Soo from Sudbury I hit a doe at about 95-105. I'll take my chances with a relatively controlled impact over being rear ended at speed any day.

Stopped her car in a live lane on a highway with no shoulder, turned off her vehicle and exited it to play Benny Hill with some ducks. Any of you excusing what she did are just as dumb as she is. You're blaming the victim for her stupid actions which got two people killed. Glad she got the book thrown at her, in Ontario I'm sure she'd be off scot-free and back in her car the next day.
 
What many fail to grasp in the drama is that the sentencing AFAIK (correct me if I am wrong) has not been made AND all the talk of jail time is maximum possible, not what she will get. It is unlikely she will get 14 years, more likely some small amount if any jail time... some community service, parole, etc.

She does get the record though...

She did turn down a deal and decided to go for broke... IMO the conviction is good and this should happen more often.

She will probably do time in Jail instead of Prison, i.e. 2 years less a day type sentence. Quebecers despite having bleeding heart liberal borderline socialist governments have been very pragmatic as far as the ones I've met. I don't see her getting off with probation/community service if she opted for the trial.
 
Im of two opinions on this, I think she is a moron for stopping to save some ducks on a damn highway. I have stopped to help animals, but not on a damn highway that is nuts. I do think she was rightly convicted, but I don't think her life should be over for it, I don't think jail time is the answer for this woman.

What she did was stupid, but it was not malicious. 10 years of community service would suffice, along with the guilt she will live with for the rest of her life.

There's only one person who really knew what happened, and he's dead.
All the rest unfortunately, is conjecture.
Were there any expert witnesses, who could testify whether he should have been able to stop or swerve?
Were the skid marks measured?
Did she put the best defence possible, forward?

Respectfully, that's not the point though. If I leave sharp garden shears or a loaded gun out in my backyard and my kid cousin hurts himself I'm criminally negligent. He's an idiot, but that doesn't excuse my actions.

The fact remains she acted negligently. Perhaps if the rider was alive he'd be charged with Driving without due care and attention, maybe he'd even be charged for his daughter being killed. We'll never know because he's dead now.

Good verdict, I applaud the jury for their correct, non-bleeding-heart decision. Hopefully this will send a message to other would be duck saviors who are thinking of stopping in a live lane on a highway.

and here I was at the lake when a flock of ducks swam up to me, literally a few feet away...all I was thinking is how stupid they are and if I just had a slingshot I'd be grilling fresh duck that night...
 
This had been commented on every which way another ago.

If you have a mechanical issue while driving or what ever reason there is, I believe any reasonable person would look to pull over to the safest place they can. Assuming the worst, I would imagine it bring possible to coast the vehicle to the right hand side and off the road.

You never know.

I would be worried about a tractor running be down under any circumstance. Not to mention all the other down side of having to pull over fir a break down or what ever.

I've encountered ladders Nd other things on the road and been tempted to pull over. But it's too dangerous to me and others.

The operator wasn't intentionally out to kill anyone. But she is responsible according to the judgement.

It's sad.

I've stopped to let geese cross a road in a city street. But I don't leave my vehicle to help then to a safe spot. And I'm aware of my surroundings. I wouldn't run then down because I didn't want to hold up traffic.

I've killed a few animals while driving or riding. It happens. I feel bad. But I'm not going to put myself or anyone else in danger to save some animals. Sorry.
 
Maybe it's on the record (haven't read everything) but I'd like to know what was and is her genuine reaction to what she has done? I think most of us have done something really stupid and meaning no harm. I know this goes counter to everything we believe to our core but paying for a very stupid decision doesn't have to be the end of the world. A little bit of soft woman jail time shouldn't ruin her life, maybe puts a small ding in it, unlike the back of her car. Those were actual people that hit her.
 
Just have to add one thing here. It seems many of you are questioning how the bike didn't see the car. Well just an FYI, there was third party witness testimony in trial stating this head case didn't even bother putting on the hazard lights. She was rightfully convicted for her negligence.
 
Ever been behind a car that swerved around some roadkill at the last second and you end up going right through it because you couldn't see it until the guy ahead of you swerved? That's how

Cant say I have as I tend not to trail cagers that close for just that reason! thats one thing that I have learned in my 23 years of riding on the streets. its a shame it had to happen.
