Say instead of the motorcycle hitting her backside but a car would she be charged any differently? Sadly it's the outcome that is a lot different and what infuriates most riders as our lives are always at risk.
The law does not differentiate between a car and motorcycle but when people come to the scene of an accident with a bike and a car even being the cars fault it always seems to look like the blame was put on the bike.

A friend of mine was riding in the right lane approaching an intersection with a car 2 lanes over in the far left lane. The car decide last minute to make a right turn and without looking/noticing him hit him causing him to fall and tumble. The outcome a written off bike, broken ankle, wrist and head trauma. Now tell me who would be at fault in this type of accident?....well guess what the driver walked away with nothing
