    Quick Speeding ticket question

    Hey guys,

    Can anyone tell me what is required in court to convict a defendant for a speeding charge?

    Are the officer's notes, as well as his testimony enough? Or does a Radar Reading NEED to be provided as evidence?

    It would be helpful if you told us why you are asking this question. I am assuming that you are preparing your disclosure request. Here's what I requested for a 128 charge:
    1. both sides of the officer's copy of the ticket;
    2. any statements the defendant had made to the police;
    3. any witnesses' statements;
    4. the list of witnesses that the Crown will call to testify in this matter;
    5. typed copy of the officer's notes regarding the incident;
    6. make, model and serial number of the device used to measure the defendant's vehicle's speed;
    7. copy of the speed measuring device's manual sections relevant to maintenance, testing and calibration;
    8. copy of the speed measuring device's maintenance, testing and calibration logs for the date of the offence;
    I also included the following note:
    Please make sure that due to my difficulties with reading hand-writing, any notes that the officer made in his notebook or the back of the ticket get typed up and that any short-hand writing get translated into plain English.

    Well, without revealing too much; the offense date was in July, and my Trial is today.

    I asked for disclosure, and all I received was the officer's notes, although I did not specifically ask for the radar reading, I asked for "any and all relevant information and documentation" pertaining to the case. I did ask for a typed version of his notes, which I did not receive.

    That's where you messed up. If you used a standard disclosure form or just weren't specific enough, they get to decide what "any and all relevant information and documentation" is. Hopefully you lucked out @ trial. Keep us posted.
